Getting around
The house is located on a paved road, set back over 500 feet on a wooded lot. The driveway is packed gravel and easily navigable by cars, SUVs, or trucks alike. In the winter, the driveway is plowed and sanded as needed. The driveway has a loop and there is plenty of space to park your vehicles and any trailers for your big toys. Just be sure not to ride those big toys on our property, please. You'll feel like you're staying out in the woods (because you are) but only 8-12 minutes from Mount Snow and Stratton Mountain and the many restaurants and shops in Dover, Stratton, and Wilmington. There are markets and country stores located as close as 3 minutes from the house so that you can buy food or head to town for a meal or takeout.

VACATION RENTAL / SHORT TERM LEASE AGREEMENT
This is a Short-Term Lease Agreement (the “Agreement”) made by and between, (“Owner”) and ________ (“Guest”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
Guest agrees to abide by the terms and rules below always while at the Property and shall cause all members of the Rental Group and anyone else guest permits on the property to abide by the following terms and rules while at the Property.
Property. The Property is approximately 4 acres with a single-family home, described as having 4 bedrooms and 2 bathrooms and located at 347 Stratton Arlington Rd, Stratton, VT (Phone number hidden by Airbnb) the “Property”). The Property is owned by Owner. The Property is fully furnished by Owner.
Rental Period & Check-In. The term (“Term”) of this Agreement will be from ________ (“Arrival Date”) to __________ (“Departure Date”). The Property will be ready for Guest’s occupancy beginning at 4:00 PM on the Arrival Date and the Property must be vacated by 10:00 AM on the Departure Date, unless otherwise agreed by Owner. If Guest or any member of the Rental Group remains on the Property beyond the Departure Date at the departure time, Guest will be responsible to pay the rental rate of $1, (Phone number hidden by Airbnb) per day or any part thereof for the period of time between Departure Date and the actual date Guest and all members of the Rental Party vacate the Property.
Maximum Occupancy. The maximum number of persons allowed to stay in the Property is limited to eight (8) unless the Owner gives their prior written consent.
Visitors. A visitor is an occupant of the Property who is not listed in the Rental Group. No visitors are allowed on the Property at any time. Guest agrees to pay $200 per person, per day or any part of a day that a Visitor is allowed on the Property contrary to this agreement during the Rental Period.
Rental Group. All persons in the Rental Group will be bound by the terms of this Agreement. Only persons listed in the Rental Group may enter the Property. No other persons may visit the Property or spend time at the P
_X__The Agreement was initiated through an online travel agent (“OTA”) (e.g. (Hidden by Airbnb) , Airbnb, etc.) and the rental amount, fees, taxes, and deposits specified in the OTA booking will apply.

Payment will be made by Guest to Owner via (Hidden by Airbnb) or other payment method agreed to by the Parties that carries no additional fee to the Owner. If payment is made via credit card, Guest will pay a 3.5% processing fee to Owner on the entire rental amount. Guest will provide a security deposit (“Deposit”) of $ (Phone number hidden by Airbnb) on the effective date of this Agreement. The Deposit will be held by Owner and used to pay for any damages to the Property or contents or any fines incurred during the Term. All remaining Deposit funds after deductions will be returned to Guest within 14 days of the end of the Term. Failure to pay all amounts due at the effective date will nullify this Agreement in its entirety.
Cancellation. The following cancellation policy applies to this Agreement (mark one):

Self-Catering. The Property is rented on a self-catering basis. Owner will provide bed linens and bath towels. Owner will also provide a starter supply of select household cleaning and personal hygiene products in the Property for Guest use. Guest is responsible for purchasing any additional supplies needed and all food and beverages.
Access. Owner will provide Guest with an electronic code to unlock the front door to the Property. Any attempt to access a locked area inside the home is just cause for immediate termination of this Agreement, forfeiture of all rent paid, and Guest will be liable for any missing items or damage.
No smoking. No smokers. The Property is smoke free. Absolutely no smoking or burning of any kind (cigarettes, e-cigarettes, vaping, marijuana, drugs, hookah, incense et. al.) is allowed anywhere on the Property. We rent only to non-smokers. Smokers are not allowed in the house, even if you smoke or vape outside, as Owner is allergic to smoke residue. Failure to comply with this rule will result in a charge of at least $500 to Guest. Any smell or evidence of smoking, vaping, incense, that leaves a lasting smell will be determined at the sole discretion of the Owner. Guest agrees to waive any challenge due to lack of visual or physical evidence.
No pets, service animals, or emotional support animals. The Owner is allergic to pet hair and dander and so no animals of any kind are allowed in the home at any time. Failure to comply with this rule will result in a charge of at least $500 to Guest.
Ski Equipment. All skis, ski poles, and snowboards are not allowed in the house. Skis, poles, and snowboards must be kept in or on guest vehicles or in the garage. Ski boots can be kept in the house, but must only be in the front entryway. Ski boots cannot be worn when walking on the wood floor.
Cleaning. Daily housekeeping services are not included in the rental rate. Throughout the rental period, Guest will be responsible for keeping the Property clean and in good condition. Dishes, glasses, utensils, pots, and pans should be cleaned and put away where taken from at the end of the Term.
Good condition. Any unsafe or dangerous condition must be reported to Owner immediately. Guest acknowledges that on the Arrival Date, the Property is in good condition, except for any defect Guest may report to Owner by the end of the first day following the Arrival Date. The Property should be left in the same condition as it was found by Guest on the Arrival Date. Guest promises to leave the Property in good repair.
Furnishings. Furniture, bedding, kitchen equipment, utensils, and any other household goods and personal property supplied with the Property must not be removed from the Property. The Property will be inspected by Owner or Owner’s representative after Guest’s departure. Guest agrees to pay for replacement of any items that are missing from the property or damaged in excess of normal wear and tear at the end of the Term. All contents of the Property are the property of Owner. If an item should break, Guest must notify Owner immediately. Guest is not permitted to move any furniture or to alter the wiring of any television. Furnishings are subject to change without notice.
Driveway and Parking. The property has a gravel driveway. Guest may park personal vehicles in the driveway. Large commercial vehicles and commercial trucks are prohibited. Parking is not allowed anywhere other than the gravel driveway. During the snow season, Owner employs a snow plow service to plow snow from the driveway. The service does not include cleaning snow from Guest cars or shoveling them out. Owner provides a shovel for Guest use at their own risk while staying at the property. Owner is not responsible for vehicles getting stuck on the property or damage due to snow removal operations.
Maintenance or Mechanical failure. Owner attempts to properly maintain the Property, it’s systems, and appliances. While all electrical and mechanical equipment within the Property are in good working order, Owner cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, audio visual equipment, internet access, streaming TV service, or appliances. Guest agrees to report any inoperative equipment or other maintenance problem to Owner or Owner’s designated agent immediately. Owner will make every reasonable effort to have repairs done quickly and efficiently. Guest will allow Owner or a person permitted by Owner access to the Property for purposes of repair and inspection.
Security cameras. Security cameras are located around the exterior of the Property. The cameras are to ensure maintenance contractors are taking care of the Property, for security, and to ensure compliance with guest limits and house rules. There are no cameras or recording devices inside the home.
Garage. There is no parking allowed in the garage. During snow season, guests may store skis, poles, and snowboards in the garage.
Tree House. There is a Tree House located behind the house on the Property. The Tree House has a rustic log staircase with large gaps and a limited railing. Additionally, it is supported by logs. Use of the Tree House by Guest is at Guest’s own risk. Owner will not be liable for any injury as a result of Guest or Rental Group use of the Tree House.
Fireplace. The Property has a wood-burning fireplace with an insert. Guests may use the fireplace at their own risk and are responsible for any damage caused to the Property from its use. The flue vent must be opened during and for at least 24 hours after the end of any fire. The vent is controlled by a slide on the upper right of the insert. Left is closed. Right is open. The insert is designed and should only be used with the door in the closed and locked position except when loading wood and starting or tending the fire. Heat is brought from the insert to the room via an electric fan that can be turned on with a switch recessed behind the grate below the insert door and a dial that controls the speed of the fan. The Owner will make reasonable efforts to secure a reasonable supply of firewood for guest use during their stay however, no guarantee is made that any firewood is available or that sufficient firewood for guest’s use is available. Firewood provided at the Property is for use by guests on the Property during their stay only and should not be taken from the Property for any reason. Guests may simply leave ashes in the fireplace.
Sauna. The Property contains a sauna in the first floor bathroom. Guest use of the sauna is at their own risk.
Children ages five and under are not permitted in the sauna.
Children between the ages of six and 16 must be accompanied by an adult in the sauna at all times.
Allow yourself at least five minutes after exercising to cool down before entering the sauna.
Pregnant women and persons suffering from heart disease, diabetes, high or low blood pressure, circulatory or respiratory problems, seizures or epilepsy should not enter the sauna without prior medical consultation.
Do not use the sauna while under the influence of any type of alcohol, drugs, anticoagulants, antihistamines, vasoconstrictor, vasodilators, stimulants, hypnotics, narcotics or tranquilizers.
Clean swim attire must be worn and participants are required to bring a towel to sit on when using the sauna.
Remove all metal jewelry prior to entering the sauna.
The surface of the rocks, heater and surrounding area can be extremely hot. Exercise caution.
Prolonged use of sauna is not recommended due to fatiguing effects. Limit yourself to a maximum of 15 minutes.
Do not smoke, exercise, eat or drink beverages in the sauna room.
Leave the sauna immediately if you experience any nausea, dizziness, hot flashes, cold chills, headaches or other discomfort.
Drink plenty of fluids before and after leaving the sauna.
This sauna is a dry sauna. Please do not pour water on the electric coals.
Do not use the sauna to dry clothes, swimsuits or towels or place materials near the heater or guard fence.
Newspapers, magazines, or other reading materials are prohibited.
Pest control. Insects and mice are a part of life in Vermont. The Property is regularly serviced by a pest control company to eliminate/minimize insects and mice. Even with preventative treatment, it is possible to see an insect or mouse inside the home. Guest will contact Owner with any pest concerns during the Term and Owner will arrange for treatment of the Property as soon as practicable.
Check out procedures. Guest and Rental Group are expected to care for the Property and treat it with respect during their stay. This includes but is not limited to:
Clean up so that the premises are in a good, clean condition at the end of your stay.
All trash is collected, bagged and placed in the garage for pickup.
Any leftover food should be disposed of and not left in the refrigerator or cabinets.
Any dishes or cookware that were used are washed clean and returned to their place.
All windows are closed and locked.
All lights and televisions are turned off.
Sliding doors and front door are securely closed and locked.
Maintenance. Owner has secured services to keep the Property in good condition. These include but are not limited to trash service, plowing, lawn service, and preventative pest control. These companies will complete their work on the exterior of the Property during Guest’s stay. Guest agrees to provide company’s representatives with access necessary to complete their work. Should maintenance work be required inside the home, Owner or management company or service provider will attempt to notify Guest by phone or electronic message with reasonable notice in advance. In the event of an urgent maintenance issue or emergency, Owner or Owner’s agent may enter the Property without prior notice.
Trash and Recycling. Guest agrees to place all trash in trash cans in the kitchen or bathrooms. If any bag becomes full, Guest agrees to tie the bags and place them inside the garage for pickup. Items to be recycled must be cleaned and bagged separately from trash. Guest understands that failure to bag and tie garbage or recycling bag resulting in loose garbage requiring clean up may result in a fine of up to $25 per occurrence, payable by the Guest. The fine goes to cover costs to have trash and/or recycling picked up and hauled away.
Prohibited Uses. The following uses and activities are prohibited on the Property at all times: fireworks, pyrotechnics of any kind, filming or recording videos or photography for profit or commercial use, maintaining motor vehicles, running or riding of any off-road vehicles including but not limited to ATVs, snowmobiles, and motorbikes.
Acts of Nature. If the home is in good condition and available for use, no refunds will be given if there is a storm or severe weather (i.e. hurricane, earthquake, forest fire) even if a mandatory evacuation order has been given. Owner will not be liable or deemed in default under this Agreement for any failure to perform or delay in performing any of its obligations due to or arising out of any act not within its control, including, without limitation, acts of nature. Guest may choose to purchase private travel insurance to cover the risk of unforeseen acts of nature, road closures, airport, airline, or train delays.
Limitation on Liability. Owner is not responsible for any accidents, injuries or illness that occur to any member of the Rental Group or Guest’s visitors while in the Property or on the Property. Owner is not responsible for loss of personal belongings or valuables belonging to any member of the Rental Group or any of Guest’s visitors. Guest agrees to assume the risk of any harm arising from use of the Property. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL OWNER BE LIABLE TO GUEST OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE PROPERTY. IN NO EVENT WILL OWNER BE LIABLE FOR ANY DAMAGES IN CONNECTION WITH THIS AGREEMENT, EVEN IF OWNER SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
Violation of Property. If Guest or any member of the Rental Group violates any of the terms of this Agreement, including but not limited to maximum occupancy, visitors, and rental rules and restrictions, Owner may evict Guest and the Rental Group from the Property and Guest will forfeit all rent and any security deposit paid.
Governing Law. This Agreement and all transactions contemplated by this Agreement will be governed by, and constructed and enforced in accordance with the laws of the State of Vermont. Any dispute arising from this Agreement shall be resolved through mediation, then binding arbitration. If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association.
Amendments. This Agreement may be amended or modified only by a written agreement signed by both Owner and Guest.
No Waiver. Neither Owner nor Guest shall be deemed to have waived any provision of this Agreement or the exercise of any rights held under this Agreement unless such waiver is made expressly and in writing.
Severability. If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid and enforceable as though the invalid or unenforceable parts had not been included in this Agreement.
Notices. Any notice or communication under this Agreement must be in writing and sent via one of the following options: certified or registered mail (postage prepaid, return receipt requested) or electronic email transmission.
Entire Agreement. This Agreement represents the entire understanding and agreement between the Parties with respect to the subject matter of this Agreement and supersedes all other negotiations, understandings and representations (if any) made by and between the Parties.

Guest will provide a security deposit (“Deposit”) of $ (Phone number hidden by Airbnb) on the effective date of this Agreement. The Deposit will be held by Owner and used to pay for any damages to the Property or contents or any fines incurred during the Term. All remaining Deposit funds after deductions will be returned to Guest within 14 days of the end of the Term. Failure to pay all amounts due at the effective date will nullify this Agreement in its entirety.
Cancellation. The following cancellation policy applies to this Agreement (mark one):
__X_ The Agreement was initiated through an online travel agent (“OTA”) (e.g. (Hidden by Airbnb) , Airbnb, etc.) and the cancellation policy in the OTA booking will apply to this Agreement.
____ The Agreement was booked directly with Owner and Guest may cancel this Agreement for 85% refund at least 60 days prior to Arrival Date. If Guest cancels after that point, Guest will not get a refund.
Self-Catering. The Property is rented on a self-catering basis. Owner will provide bed linens and bath towels. Owner will also provide a starter supply of select household cleaning and personal hygiene products in the Property for Guest use. Guest is responsible for purchasing any additional supplies needed and all food and beverages.
Access. Owner will provide Guest with an electronic code to unlock the front door to the Property. Any attempt to access a locked area inside the home is just cause for immediate termination of this Agreement, forfeiture of all rent paid, and Guest will be liable for any missing items or damage.
No smoking. No smokers. The Property is smoke free. Absolutely no smoking or burning of any kind (cigarettes, e-cigarettes, vaping, marijuana, drugs, hookah, incense et. al.) is allowed anywhere on the Property. We rent only to non-smokers. Smokers are not allowed in the house, even if you smoke or vape outside, as Owner is allergic to smoke residue. Failure to comply with this rule will result in a charge of at least $500 to Guest. Any smell or evidence of smoking, vaping, incense, that leaves a lasting smell will be determined at the sole discretion of the Owner. Guest agrees to waive any challenge due to lack of visual or physical evidence.
No pets, service animals, or emotional support animals. The Owner is allergic to pet hair and dander and so no animals of any kind are allowed in the home at any time. Failure to comply with this rule will result in a charge of at least $500 to Guest.
Ski Equipment. All skis, ski poles, and snowboards are not allowed in the house. Skis, poles, and snowboards must be kept in or on guest vehicles or in the garage. Ski boots can be kept in the house, but must only be in the front entryway. Ski boots cannot be worn when walking on the wood floor.
Cleaning. Daily housekeeping services are not included in the rental rate. Throughout the rental period, Guest will be responsible for keeping the Property clean and in good condition. Dishes, glasses, utensils, pots, and pans should be cleaned and put away where taken from at the end of the Term.
Good condition. Any unsafe or dangerous condition must be reported to Owner immediately. Guest acknowledges that on the Arrival Date, the Property is in good condition, except for any defect Guest may report to Owner by the end of the first day following the Arrival Date. The Property should be left in the same condition as it was found by Guest on the Arrival Date. Guest promises to leave the Property in good repair.
Furnishings. Furniture, bedding, kitchen equipment, utensils, and any other household goods and personal property supplied with the Property must not be removed from the Property. The Property will be inspected by Owner or Owner’s representative after Guest’s departure. Guest agrees to pay for replacement of any items that are missing from the property or damaged in excess of normal wear and tear at the end of the Term. All contents of the Property are the property of Owner. If an item should break, Guest must notify Owner immediately. Guest is not permitted to move any furniture or to alter the wiring of any television. Furnishings are subject to change without notice.
Driveway and Parking. The property has a gravel driveway. Guest may park personal vehicles in the driveway. Large commercial vehicles and commercial trucks are prohibited. Parking is not allowed anywhere other than the gravel driveway. During the snow season, Owner employs a snow plow service to plow snow from the driveway. The service does not include cleaning snow from Guest cars or shoveling them out. Owner provides a shovel for Guest use at their own risk while staying at the property. Owner is not responsible for vehicles getting stuck on the property or damage due to snow removal operations.
Maintenance or Mechanical failure. Owner attempts to properly maintain the Property, it’s systems, and appliances. While all electrical and mechanical equipment within the Property are in good working order, Owner cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, audio visual equipment, internet access, streaming TV service, or appliances. Guest agrees to report any inoperative equipment or other maintenance problem to Owner or Owner’s designated agent immediately. Owner will make every reasonable effort to have repairs done quickly and efficiently. Guest will allow Owner or a person permitted by Owner access to the Property for purposes of repair and inspection.
Security cameras. Security cameras are located around the exterior of the Property. The cameras are to ensure maintenance contractors are taking care of the Property, for security, and to ensure compliance with guest limits and house rules. There are no cameras or recording devices inside the home.
Garage. There is no parking allowed in the garage. During snow season, guests may store skis, poles, and snowboards in the garage.
Tree House. There is a Tree House located behind the house on the Property. The Tree House has a rustic log staircase with large gaps and a limited railing. Additionally, it is supported by logs. Use of the Tree House by Guest is at Guest’s own risk. Owner will not be liable for any injury as a result of Guest or Rental Group use of the Tree House.
Fireplace. The Property has a wood-burning fireplace with an insert. Guests may use the fireplace at their own risk and are responsible for any damage caused to the Property from its use. The flue vent must be opened during and for at least 24 hours after the end of any fire. The vent is controlled by a slide on the upper right of the insert. Left is closed. Right is open. The insert is designed and should only be used with the door in the closed and locked position except when loading wood and starting or tending the fire. Heat is brought from the insert to the room via an electric fan that can be turned on with a switch recessed behind the grate below the insert door and a dial that controls the speed of the fan. The Owner will make reasonable efforts to secure a reasonable supply of firewood for guest use during their stay however, no guarantee is made that any firewood is available or that sufficient firewood for guest’s use is available. Firewood provided at the Property is for use by guests on the Property during their stay only and should not be taken from the Property for any reason. Guests may simply leave ashes in the fireplace.
Sauna. The Property contains a sauna in the first floor bathroom. Guest use of the sauna is at their own risk.
Children ages five and under are not permitted in the sauna.
Children between the ages of six and 16 must be accompanied by an adult in the sauna at all times.
Allow yourself at least five minutes after exercising to cool down before entering the sauna.
Pregnant women and persons suffering from heart disease, diabetes, high or low blood pressure, circulatory or respiratory problems, seizures or epilepsy should not enter the sauna without prior medical consultation.
Do not use the sauna while under the influence of any type of alcohol, drugs, anticoagulants, antihistamines, vasoconstrictor, vasodilators, stimulants, hypnotics, narcotics or tranquilizers.
Clean swim attire must be worn and participants are required to bring a towel to sit on when using the sauna.
Remove all metal jewelry prior to entering the sauna.
The surface of the rocks, heater and surrounding area can be extremely hot. Exercise caution.
Prolonged use of sauna is not recommended due to fatiguing effects. Limit yourself to a maximum of 15 minutes.
Do not smoke, exercise, eat or drink beverages in the sauna room.
Leave the sauna immediately if you experience any nausea, dizziness, hot flashes, cold chills, headaches or other discomfort.
Drink plenty of fluids before and after leaving the sauna.
This sauna is a dry sauna. Please do not pour water on the electric coals.
Do not use the sauna to dry clothes, swimsuits or towels or place materials near the heater or guard fence.
Newspapers, magazines, or other reading materials are prohibited.
Pest control. Insects and mice are a part of life in Vermont. The Property is regularly serviced by a pest control company to eliminate/minimize insects and mice. Even with preventative treatment, it is possible to see an insect or mouse inside the home. Guest will contact Owner with any pest concerns during the Term and Owner will arrange for treatment of the Property as soon as practicable.
Check out procedures. Guest and Rental Group are expected to care for the Property and treat it with respect during their stay. This includes but is not limited to:
Clean up so that the premises are in a good, clean condition at the end of your stay.
All trash is collected, bagged and placed in the garage for pickup.
Any leftover food should be disposed of and not left in the refrigerator or cabinets.
Any dishes or cookware that were used are washed clean and returned to their place.
All windows are closed and locked.
All lights and televisions are turned off.
Sliding doors and front door are securely closed and locked.
Maintenance. Owner has secured services to keep the Property in good condition. These include but are not limited to trash service, plowing, lawn service, and preventative pest control. These companies will complete their work on the exterior of the Property during Guest’s stay. Guest agrees to provide company’s representatives with access necessary to complete their work. Should maintenance work be required inside the home, Owner or management company or service provider will attempt to notify Guest by phone or electronic message with reasonable notice in advance. In the event of an urgent maintenance issue or emergency, Owner or Owner’s agent may enter the Property without prior notice.
Trash and Recycling. Guest agrees to place all trash in trash cans in the kitchen or bathrooms. If any bag becomes full, Guest agrees to tie the bags and place them inside the garage for pickup. Items to be recycled must be cleaned and bagged separately from trash. Guest understands that failure to bag and tie garbage or recycling bag resulting in loose garbage requiring clean up may result in a fine of up to $25 per occurrence, payable by the Guest. The fine goes to cover costs to have trash and/or recycling picked up and hauled away.
Prohibited Uses. The following uses and activities are prohibited on the Property at all times: fireworks, pyrotechnics of any kind, filming or recording videos or photography for profit or commercial use, maintaining motor vehicles, running or riding of any off-road vehicles including but not limited to ATVs, snowmobiles, and motorbikes.
Acts of Nature. If the home is in good condition and available for use, no refunds will be given if there is a storm or severe weather (i.e. hurricane, earthquake, forest fire) even if a mandatory evacuation order has been given. Owner will not be liable or deemed in default under this Agreement for any failure to perform or delay in performing any of its obligations due to or arising out of any act not within its control, including, without limitation, acts of nature. Guest may choose to purchase private travel insurance to cover the risk of unforeseen acts of nature, road closures, airport, airline, or train delays.
Limitation on Liability. Owner is not responsible for any accidents, injuries or illness that occur to any member of the Rental Group or Guest’s visitors while in the Property or on the Property. Owner is not responsible for loss of personal belongings or valuables belonging to any member of the Rental Group or any of Guest’s visitors. Guest agrees to assume the risk of any harm arising from use of the Property. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL OWNER BE LIABLE TO GUEST OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE PROPERTY. IN NO EVENT WILL OWNER BE LIABLE FOR ANY DAMAGES IN CONNECTION WITH THIS AGREEMENT, EVEN IF OWNER SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
Violation of Property. If Guest or any member of the Rental Group violates any of the terms of this Agreement, including but not limited to maximum occupancy, visitors, and rental rules and restrictions, Owner may evict Guest and the Rental Group from the Property and Guest will forfeit all rent and any security deposit paid.
Governing Law. This Agreement and all transactions contemplated by this Agreement will be governed by, and constructed and enforced in accordance with the laws of the State of Vermont. Any dispute arising from this Agreement shall be resolved through mediation, then binding arbitration. If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association.
Amendments. This Agreement may be amended or modified only by a written agreement signed by both Owner and Guest.
No Waiver. Neither Owner nor Guest shall be deemed to have waived any provision of this Agreement or the exercise of any rights held under this Agreement unless such waiver is made expressly and in writing.
Severability. If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid and enforceable as though the invalid or unenforceable parts had not been included in this Agreement.
Notices. Any notice or communication under this Agreement must be in writing and sent via one of the following options: certified or registered mail (postage prepaid, return receipt requested) or electronic email transmission.
Entire Agreement. This Agreement represents the entire understanding and agreement between the Parties with respect to the subject matter of this Agreement and supersedes all other negotiations, understandings and representations (if any) made by and between the Parties.
