“RiverView at Beechers Point” Rental Agreement Thank you for choosing “RiverView at Beechers Point” for your vacation accommodation! In addition to explaining the policies and procedures for your booking and stay, this Rental Agreement will serve as a BINDING CONTRACT between you, the registered guest(s) booking the vacation rental, and the Hosts of the home. Making any payment to reserve this home constitutes acceptance of the terms and conditions detailed in this agreement. DEFINITIONS The “Home” shall mean “RiverView at Beechers Point” home located at 136 Beecher’s Point Drive, Welaka, FL 32193. “Guest” shall refer to the primary guest or guests making the reservation as well as all other approved members in their party that will be staying at the home. “Host” shall refer to the owners Gary and Brenda Elliott. AGE REQUIREMENT AND NUMBER OF GUESTS Primary Guest must submit a copy of driver license or ID to Host as proof of age. Host reserves the right not to rent to any primary guest under the age of 25. Guest may not exceed the maximum number of occupants approved by Host in the reservation. (Florida Law 509.151 provides that procuring accommodations under false pretense, such as having more guests than stated, is a crime punishable by fines and/or imprisonment) Guest would also be subject to eviction by Host, with no refund given, for exceeding the maximum number of occupants as stated. CANCELLATION POLICY If Guest cancels the reservation 60 or more days prior to the arrival date, we will refund all monies deposited. Between 30 and 60 days, we will refund 50%. Within 30 days of the scheduled arrival date, there will be no refunds for cancellations, or for any changes that reduce the number of nights booked. Guest should consider the option of travel insurance to protect from loss of funds in the event of an emergency! ***A few travel insurance options include Faye, Squaremouth, TravelInsurance*** CHECK IN PROCEDURES After full payment has been received, we will send you directions to the home along with a dedicated access code. CHECK IN TIME IS 4PM. Your code will not be active prior to 4pm, so please do not try to check in early. On occasion, if the home is ready early and circumstances permit, you may be given early access, but please do not plan on this. HOME PROVISIONS This home is being rented AS IS. This is a vacation rental home and some things may not be exactly as they appear in photos. There may be new or different furniture in an effort to provide our guests with a great accommodation. Bed linens and bathroom towels are provided. A complimentary “starter supply” of trash bags, toilet paper, paper towels, laundry soap, and shower supplies are provided. Basic kitchen cookware and dishware are provided. Maid service is NOT provided. CHECK OUT PROCEDURES CHECK OUT TIME IS 10AM. If Guest checks out later than 10am, Host may charge Guest up to $50 per hour for the delay. (Home cleaners are on very tight schedules and delays can be costly.) A Check-Out Checklist will be provided to the Guest with instructions on what steps to take when securing the Home. Guest assumes full responsibility and agrees to pay for damages and/or missing items from the Home. (Inventories WILL be taken before and after your stay.) PET POLICY Pets are not allowed at RiverView at Beecher’s Point. If a pet is found, or evidence of a pet is found, you will be asked to vacate the home with no refund given. In such case, Guest will also be liable for any additional cleaning necessary as well as any damages caused by the pet. SMOKING POLICY Our home is NON-SMOKING. A minimum of $200 will be charged for additional cleaning and fumigation in the event that evidence of smoking is found in the home or screened porch. WATERFRONT PROPERTY WITH DOCK The property is waterfront property which creates a risk of personal injury or property damage. This risk is heightened as it relates to children. Guest accepts the risk and takes ALL responsibility to ensure the safety of all guests. Dangers and health risks associated with its use include but are not limited to falls, drownings and slippery surfaces. Elderly persons, infants, pregnant women, people with health conditions requiring medical care SHOULD NOT use the dock. The dock shall be entered at Guest’s own risk. Guest must wear appropriate footwear. Guest should walk only while on dock or surrounding area. Items excluded from dock include but are not limited to bicycles, baby strollers, skateboards, hoverboards or walkers. Use of the boat and jet-ski lifts is NOT permitted. Please do not stand or sit on the boat or jet-ski lifts! Damage to a jet-ski or boat lift will incur a minimum charge of $400. Children (up to 17 years of age) must be accompanied and supervised at all times while on the dock and surrounding property. Please do not lift cover off or tamper with the MosquitoNix drum. Horseplay is strictly prohibited on the dock and surrounding property. DO NOT consume alcohol, narcotics, or medication while on the dock. Florida waters include wildlife such as alligators and poisonous snakes. Swim at your own risk. A flotation device is provided on dock in case of emergency. WATERCRAFT POLICY Watercraft up to 40 feet are permitted. Boats are to use center slip under the tallest part of the boathouse. Watercraft must be secured well and bumpers are required to keep boat away from and protect the slip and dock structure. Jet-skis are permitted to moor along dock where cleats are provided. Please notify host PRIOR to arrival if you will be bringing watercraft. DAMAGES We require a damage deposit of $250 from the Guest. If there are any damages, missing items, excessive cleaning, or other charges for violations of the Rental Agreement, these costs will be deducted from your damage deposit after you depart. The remainder of your damage deposit will be returned to you within 14 days after departure. If there are no claims against your deposit, your deposit will typically be returned much sooner. If there are charges that exceed the amount of the security deposit, Guest will be fully responsible for their contractual obligations. Items that are damaged or stolen as a result of the home being left unsecured by the Guest will be the responsibility of the Guest at full replacement value. Any theft, vandalism, or evidence of illegal activity will be reported to the police and possibly be followed by litigation. MAINTENANCE AND REPAIRS If you have any maintenance issues or inoperative equipment in the home during your stay, please notify the Host promptly. Host will make every attempt to correct the problem as quickly as possible, but will not be held responsible for delays that are beyond the Host’s control. GUEST CONDUCT Guests have the right to peacefully enjoy their vacation rental, and should not infringe on the right of neighbors to do the same. Quiet hours are from 10pm to 8am. Parties or gatherings of non-authorized guests in the home are strictly prohibited. Please do not park vehicles on street. Children are welcome, but the home is not child-proofed. It is the Guest’s responsibility to safeguard children. If illegal activity or destructive behavior by the Guest is reported, police will be called and Guest may be evicted with no refund given. Host will notify Guest of any noise complaints. If more than two noise complaints are received, Guest may be evicted with no refund given. WEATHER Florida weather can be unpredictable. We do not offer discounts or refunds if you are unable to arrive because of weather conditions. WILDLIFE AND PESTS Please help protect wildlife! Guests are requested not to feed or bait alligators, raccoons or other animals. Feeding wild animals usually guarantees their eventual demise. Please ensure that trash is placed in the covered containers provided outside near the screened porch area. The home is treated monthly for pest control. If you see evidence of a pest problem during your stay, please report it to the Host promptly so we can call for re-treatment. FIRE HAZARDS Use of fireworks is strictly prohibited. Guests should take great care to prevent accidental fires when using the charcoal grill. If smoking outside of home or screened porch, please dispose of cigarette butts properly. There are smoke detectors in the home as well as fire extinguishers located under the kitchen and master bathroom sinks. INDEMNITY CLAUSE The Host will not be responsible for any accidents or injuries suffered by Guests while using the home or dock for loss of money or valuables of any kind. By completing this booking, the registered guest expressly agrees to assume the risk of any harm to themselves or their invitees arising from their use of the home or dock. The registered guest will be financially responsible for any damages or charges incurred which are caused by any member of their group or other person that they invite onto the premises. While every effort will be made to return any items left behind by the Guest after departure, Host cannot guarantee that such items will be found and/or reported by cleaning staff. ATTORNEY FEES CLAUSE If the two parties to this agreement enter into a legal action, it is agreed that the losing party will pay all prevailing party reasonable attorney fees.
