Refundable Damage Deposit
Short-Term Rental Damage Deposit Agreement
This Damage Deposit Agreement is an integral part of the Short-Term Rental Agreement between The Ocean Oasis ("Owner") and ("Guest") for the rental property. This agreement outlines the terms under which the damage deposit ("Deposit") is held and administered.
**1. Damage Deposit Amount:**
The Guest agrees to pay the Owner a damage deposit of $750.00 USD, due upon booking confirmation. This Deposit is held to cover any damage, loss, or additional cleaning fees incurred to the Property, excluding normal wear and tear, during the Guest's stay.
**2. Deposit Holding:**
The Deposit will be held by the Owner or the Owner's designated agent. It will not be applied toward rent unless expressly agreed upon by both parties in writing.
**3. Inspection and Documentation:**
The Owner agrees to document the Property's condition before Check-In and after Check-Out to determine if damage has occurred. This may include taking date-stamped photographs or videos.
**4. Use of Deposit:**
The Deposit may be used to cover:
a. Damage to the Property or its contents, excluding normal wear and tear.
b. Cleaning fees in excess of the standard cleaning expected following the Guest's departure.
c. Replacement of lost keys or security devices.
d. Any other charges outlined in the Short-Term Rental Agreement due to the Guest's actions or inactions.
**5. Refund of Deposit:**
The Deposit, or any remaining portion thereof, will be refunded to the Guest within 7 days days after the Check-Out Date, provided that:
a. No damage to the Property has been reported by the Owner.
b. The Property is left in a similar condition as found upon Check-In.
c. All terms of this Agreement and the Short-Term Rental Agreement have been adhered to.

c. **No Refund:** No refund will be provided for cancellations made within 14 days of the Check-In date.
**2. Cancellation by Owner:**
In the unlikely event that the Owner must cancel the reservation due to unforeseen circumstances ( Includes weather or local emergencies), the Guest will receive a full refund.
**3. Modifications:**
Guests may request modifications to their reservation dates subject to availability. Any changes must be agreed upon by both parties in writing.
**4. Refunds:**
Refunds will be processed within 7days of the cancellation date, using the original method of payment.
**5. Force Majeure:**
In the event of unforeseeable circumstances beyond the control of both parties, such as natural disasters or government-imposed travel restrictions, the cancellation policy may be adjusted at the discretion of the Owner.
By booking this rental, the Guest agrees to abide by the terms of this cancellation policy.
