Spacious Beach Residence w Backyard Pond & Hot Tub - Carlsbad

Noise is to be kept to a MINIMUM AFTER 9 PM! I'm friendly with the neighbors and would like to keep it that way. No parties. Please treat the neighborhood and home as you would your own.

Hot tub rules of use:

By booking our home, the guest agrees to the following conditions:

1. Six (6) person maximum hot tub capacity.

2. No food or drink shall be allowed in the hot tub.

3. No glassware is allowed in or around the hot tub.

4. No body lotions shall be allowed in the hot tub; please feel free to use our “outside” shower to rinse off before soaking.

5. All children under 16 years of age shall be accompanied by an adult while in the hot tub.

6. No infants are permitted in the hot tub.

7. Hot tub will be left in the same condition as it was found upon entry of lease agreement.

8. All individuals, including pregnant women and/or those under the influence of alcohol and/or drugs shall use the hot tub at their own risk. Pregnant or possibly pregnant women should consult a physician before using the hot tub.

9. When opening the hot tub cover, be sure to unfasten all safety straps first before lifting the cover off.

10. Guests with infectious diseases should not use the hot tub.

11. To avoid injury, exercise care when entering or exiting the hot tub.

12. Water temperature above 104*F may be injurious to your health. The optimal temperature of 94*F is already pre-set for your enjoyment.

13. Prolonged immersion in the hot tub may be injurious to your health. It is best not to soak longer than for 30-minute sessions.

14. Never stand or sit on the hot tub cover.

15. Always cover the hot tub after each use and secure the straps to ensure the safety of visiting children.

If the hot tub is damaged or otherwise mistreated during your tenancy, or if upon arrival, you find that the hot tub has been previously misused, it is your responsibility to immediately contact the host/homeowner.

By booking the home, it is your responsibility to inform every person using the hot tub of these rules and to ensure every person abides by them. It is also assumed that you understand that failure to comply with these guidelines will result in forfeiting my entire damage deposit and/or paying any additional expenses to restore the hot tub to its prior condition.

By booking, you understand that this agreement/waiver is incorporated into, and is part of, the original rent agreement between the parties.

By proceeding with the booking, you acknowledge this agreement and release the host and homeowner from any liability associated with yourself or your guests’ use of the hot tub. I have read and agree with the above-stated conditions.

Additional acknowledgments: Some of these risks can include discoloration of swimwear due to chemicals used to sanitize tubs and minor skin rashes if sensitive to the chemicals. Absolutely no dogs or unsupervised children are allowed in the hot tubs. The homeowner cannot be held responsible for hot tub injuries or discomforts. Guest acknowledges waiver of liability, including but not limited to the hot tub, pond, fire pits, herein after called special feature if so equipped. The Guest understands that there are potential risks that the special features may present; dangers to persons using the special features for too long or to persons intoxicated or using any kind of drugs or medications. Guests of special attention, including but not limited to pregnant women, elderly and disabled persons should use heavy caution while using special features. The Guest agrees to explain the risks of using the special feature to any guests at the cabin and to be fully and solely responsible for any accidents that guests may incur. The Guest understands the risks discussed above and agrees to assume all responsibility for the consequences of those risks. Guest agrees to waive any claim whatsoever against the homeowner for accidents and claims arising from the use of the special features. The Guest agrees to indemnify the homeowner for any claims arising from the Tenant’s guest's use of the special feature. The Guest also understands and agrees that he/she is responsible for any loss of equipment due to misuse and theft of equipment.

No swimming is allowed in the pond outside. We bear no responsibility for injuries, damages, or deaths incurred due to breaking this rule. Guests who break this rule enter the backyard pond fenced area at their own risk. The ring buoy is for emergency use only, not to be used as a toy or recreational device in any pool or hot tub.

The property has a single security camera up front facing the street. Footage remains private and may be used for liability reasons and to monitor occupancy, and other policies noted. It in no way infringes upon the expectation of privacy in these public areas. To disable or obscure the cameras is prohibited and may result in eviction without a refund.

Personal items: The host and homeowner are not responsible for any personal items left on the property after check out.

Maximum occupancy: The maximum number of guests in the unit is limited to what is defined in during your initial booking. The maximum occupancy includes infants and children. The maximum occupancy includes the entire property, i.e. driveways, backyard, hot tub areas, decks, and entire interior of home. If extra guests above the maximum occupancy are found on the property, the entire group may be asked to vacate the property. Any security payments and all rent will be subject to forfeiture. Absolutely no house parties are permitted. Any persons on the property above the maximum occupancy stated, are in violation of this agreement.

General:
NO LIABILITY/INDEMNIFICATION/HOLD HARMLESS: The owners of the property do not assume liability for the loss, theft, damage or injury (or death) to persons or their personal property. By booking, guests agree to indemnify and hold the owners harmless for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guests' and their visitors' use and occupancy of the rental property(this Airbnb listing), including but not limited to claims for personal injury( or death ) or property damage/loss.
