After booking, please provide your email address and we will send it to you for signature and return. Thank you and we look forward to hosting you at our home! VACATION RENTAL AGREEMENT 405 S. Fort Fisher Blvd., Kure Beach Jennifer R. Lamb, Property Owner/Manager Vacationer's (and Guest’s) Duties: Vacationer is at least 25 years of age and agrees to comply with all obligations imposed by the North Carolina Vacation Rental Act with respect to maintenance of the premises, including keeping the premises clean and safe and causing no unsafe or unsanitary conditions there. Vacationer shall not use the premises for any activity or purpose that violates any criminal law or government regulation. Vacationer agrees to abide by the owner’s non-smoking, no-pets/animals policies, as pets/animals and smoking are prohibited. Vacationer represents that the above registered guests constitute a family group, and no additional guests (beyond 6 total) shall be on the premises or using the facilities daytime/nighttime without prior written consent of the owner. Such additional guest approved by owner (up to a maximum of 8 occupants) is subject to a $150 facility usage charge. Hosting of any event or gathering is prohibited. This includes, but is not limited to, weddings, reunions, parties, celebrations, or gatherings of any kind. Vacationer accepts full responsibility for guests and ensuring their compliance with this agreement, including reimbursement to owner for any damages or charges incurred by Vacationer (or guests) as a result of their stay. Vacationer will remain on the property and personally supervise all guests on the property throughout the entire rental period. Vacationer will not assign this agreement or sublet the property without written permission from the owner. Breach of any duty contained in the agreement will be considered material and will result in automatic cancellation of the reservation, the termination of tenancy and forfeiture of Vacationer’s authorized security deposit. Security Deposit: Vacationer accepts full responsibility for any damages or charges incurred by Vacationer or guests, and hereby authorizes the Airbnb security deposit to be applied to any amounts owed by Vacationer. Vacationer shall remain personally liable for any amounts owed exceeding the security deposit. Cancellation or Trip Interruption: Travel insurance to protect against loss associated with trip cancellation or interruption is highly recommended to protect Vacationer against unexpected loss. There are many online travel insurance providers as well as websites that allow you to compare quotes of various companies to get the best rate; many guests have recommended AAA’s family care coverage with cancel anytime rider. Vacationer understands that owner is not responsible for any loss and no refund or credit will be provided to Vacationer from owner under any circumstances. Note that failure to pay monies owed herein as scheduled shall be deemed to automatically cancel the reservation with no refund or credit provided by owner. Vacationer accepts sole responsibility for procuring said travel insurance from an insurance agent. Hold Harmless: Owner is not responsible for any inconvenience for which owner has no control. This includes, but is not limited to: power outage, utility disruption, beach or weather conditions, public health exposures or mandates, hurricane or other evacuation (mandatory or voluntary), noise, failure of appliance, HVAC or other equipment, etc. No refund or credit will be given for occurrences beyond owner's control. Vacationer agrees to indemnify and hold harmless owner from and against any liability for personal injury or property damage sustained by any person (including Vacationer's guest) while occupying the premises. Owner is not responsible for theft or damage to Vacationer's (or guest's) belongings during stay or items left following departure. What Vacationer Must Bring: All beds at the property have pillows and decorative bedspreads. Vacationer needs to bring all fitted/flat sheets, pillowcases, blankets, kitchen/bath/beach towels/mats, and beach equipment to the property. Rental service is also available to Vacationer through third-party providers such as Seaside Linen and Pleasure Island Rentals, who have served past guests well. Starter house supplies such as paper products, dishwashing detergent, laundry detergent, hand soap will be provided upon arrival. Vacationer will need to replenish these starter items as they are consumed during the week and several stores are available on the island for Vacationer to purchase such products as needed. Vacationer should contact owner with any specific questions. Check-In/Check-Out Procedures: Check-in is after 3:30pm and check-out is before 9:30am. A large driveway in front of the home allows parking for 3-4 standard size vehicles. The garage (used for owner/housekeeping storage only) is not available for Vacationer use. Specific check-in and check-out procedures, along with other welcome information, will be provided by the owner on Wednesday evening prior to Vacationer’s arrival. Upon departure, Vacationer agrees to leave the owner's home tidy in the same condition as provided at the beginning of the stay in order for the owner's routine departure sanitation service to occur. This includes, but is not limited to, cleaning up dishes/utensils/cookware/bakeware/food explosions or other unreasonable messes, broom sweeping floors/decks to remove large deposits of sand, removing trash/belongings, returning items/furnishings to original locations in home, turning off lights/ceiling fans/appliances/water sources, and locking doors/windows. Owner's routine departure sanitation service is provided in the rental amount; however, any irregular or excessive non-routine cleaning as a result of Vacationer's stay is subject to charge against the authorized security deposit. Maintenance and Right of Entry: Vacationer agrees to immediately notify owner of an urgent maintenance issue, so it may be remedied by owner as soon as possible. Vacationer agrees that owner (or his representative) may enter the property during reasonable hours to inspect the property and to make repairs, alterations or improvements. Non-urgent issues may be deferred by owner until the regular maintenance window.
