This unit does have an elevator located next to the swimming pool. When you arrive, you will need to place the parking pass that will be waiting for you on the kitchen counter and immediately take it to your vehicle and leave it on the dash at all times you are parked in Emerald Waters.
On the day of your arrival when your unit is ready you will receive a text with all the necessary codes to access the property as well as any codes needed to access amenities. Don’t forget your check in time is 4:00 PM on the first day of your stay.
2. Full Payment of the total reservation costs will be required upon booking. The final payment of balance due is collected 60 days prior to arrival. Accepted payment methods are Visa, Mastercard, Discover, and AMEX.
3. Cancellation Policy: If you cancel within 24 hours of making the reservation you will receive a full refund. If you cancel 60 or more days before the first day of your reservation you will receive a refund of all rent paid minus the booking fees. All cancellations under 60 days prior to arrival will result in a forfeit of all rent payments.
4. Damage Protection – Damage Protection covers unintentional damages to the rental unit that occur during your stay, provided they are disclosed to management prior to check-out. The Damage Protection will pay a maximum benefit of $1,500.00 as a result of inadvertent acts. The Damage Protection is purchased at the time of booking and is non-refundable. Damage Protection does not cover the guest for soiled or misplaced linens, loss of keys, theft, failure to remove garbage from the property, or leaving the house excessively dirty. These fees will be charged to the payment method on file. Non-billing stipulations include: • No damage or theft to the property or items in the property. • No violations of rental or association policies. • Rental is left in a neat and orderly condition. • All garbage is removed from the house and pool areas. • All keys and garage door openers remain in the house.
5. Minimum Age. The “Minimum Age” to rent the Property is the age specified in any Unit-Specific Terms. If no age is specified in the Unit-Specific Terms, the Minimum Age is 25 years of age (or the minimum age required by law in the jurisdiction where the Property is located, if higher). You agree to provide us with proof of age upon request. A parent or legal guardian must accompany all guests who are under the Minimum Age for the entire duration of the rental. No student groups are allowed under any circumstance! Breaking of these rules will result in immediate eviction with no return of any and all payments made.
6. Maximum Occupancy. The number of people present at the Property may not exceed the maximum posted occupancy unless we have given you advance written permission to hold an event at the Property, in which case the number of people present at the Property may not exceed the maximum number of people authorized.
8. You agree that your use of the Property is on a temporary and transient basis only; that you may not use the Property as a permanent residence; and that your permanent residence is and will remain elsewhere than at the Property.
8. All properties are pet free homes unless stated otherwise in the listing. In our pet friendly homes only dogs under 25 pounds are permitted. A pet fee of $150 per pet is required with a maximum of one dog per pet friendly property. All pet breeds must be approved prior to booking. Bringing pets into a pet free home will result in forfeiture of all rent payments and all occupants will be immediately evicted. You agree that a prohibition on animals is not a guarantee than an animal has not been inside the Property or that the Property is free of animal or pet allergens.
9. This is a SMOKE FREE property. This also includes electronic cigarettes. If the property is found to be smoked in, you will be assessed a $1,000 fee. No smoking on balconies, pool area or near doors or windows. If butts are found on or around the property an additional $1,000 fee will be assessed.
10. A cleaning fee will be assessed for each reservation. The cleaning fee will vary depending on the size of the property. To avoid an extra cleaning fee, wash the dishes and leave the property in a neat and orderly condition. An additional $75 fee will be assessed if the garbage is not removed from the property at the time of check-out. Damage Protection does not cover the guest for soiled or misplaced linens, failure to remove garbage from the property, or leaving the house excessively dirty. These fees will be charged to the payment method on file. No daily maid service will be provided. Please remember to bring beach towels, we do not allow towels or linens to be removed from the property.
11. All reservations are charged a reservation fee for the processing of the reservation.
12. Most homes located in residential neighborhoods are controlled by a Homeowner Association. These associations have very strict rules that must be respected. Most violations warrant a fine that the guest will be responsible for paying. Many rental properties prohibit the onsite parking of recreational vehicles, personal watercraft (boats, trailers, jet skis, etc.) and/or restrict the number of motorized vehicles per rental unit. Guest agrees to pay for any fines for violations on their behalf; Soleil Investments LLC will charge the card on file. Please refer to the house book located in the home for specific rules of the neighborhood.
13. Quiet time for all properties is 10:00 P.M. until 7:00 A.M., in conjunction with Florida county ordinances. Please be considerate of your neighbors. Radios, stereos, and all other musical or entertainment devices will be played in compliance with the decibel level. The decibel levels cannot exceed fifty (50) decibels between the hours of 10:00 P.M. and 7:00 A.M. outdoors. Music played inside may not be heard outside of the property with the doors and windows closed. At 10:00 P.M., all guests not staying at the property need to depart from the premises. Guest agrees to pay for any fines for violations on their behalf; Soleil Investments LLC will charge the card on file.
14. Use of the Property for any criminal activity is prohibited and may result in fines, prosecution, and/or your immediate removal from the Property. This prohibition extends to use of the Property’s internet service, if any, for criminal activity, including but not limited to unlawful downloads of copyrighted material, including movies, music, software, or other material. We may cooperate with any investigation of alleged criminal activity that occurred at the Property during your stay. Guests found to be engaging in criminal activity will be immediately evicted and will forfeit any and all rents paid to Soleil Investments LLC.
15. Events and commercial photography or filming are prohibited at the Property without our express written permission. (If approved, additional conditions and fees may apply.) No tents or other structures may be erected on the property without our express written permission. The use of charcoal grills is not permitted.
16. Diving or jumping into the pool or hot tub may result in bodily harm/injuries. The renter accepts all risks associated with the use of the pool or hot tub and specifically agrees that no minor will swim unaccompanied by an adult. Community or condominium pools or hot tubs are not controlled or maintained by the host and cannot be held responsible for any inconvenience resulting from the pool or hot tub. Pools and hot tubs have electrical/mechanical components. These components can sometimes malfunction. Soleil Investments LLC, its vendors, and the homeowner cannot be held responsible for any malfunctioning pool or hot tub. Please inform us as soon as possible if your pool or hot tub is not working properly. No compensation will be given for malfunctioning pool equipment.
Liability Waiver
All Owners and Managers of this property are not liable for loss, damage of property, injury to me or my guests during my stay at the premises.
I hereby release, waive, discharge and covenant not to sue the owners of this property, its officers, staff, agents, or employees for any liability, claim and or cause of action arising out of or related to any loss, damage, or injury, including death that may be sustained by me, my guests, or to any property belonging to me arising out of use of the house or property.
Guest & their party agrees to indemnify and hold harmless, Soleil Investments, LLC, Destin Vacation Company LLC and its employees, from and against all claims, suits, damages, costs, losses, and expenses arising from injury to any person or property occurring on or about the Property.
17. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental monies, and the party will result in immediate eviction.
18. Guest agrees to report maintenance issues immediately as they are discovered. While we strive to provide speedy service, guest realizes that we need at least twenty-four (24) hours to address these issues (other than emergencies). Emergencies are defined as serious, unexpected, and often dangerous situations requiring immediate action. Examples of emergencies include air conditioning/HVAC issues, security (door locks not working, etc.), water leaks, pool alarms not shutting off or any electrical issues. Soleil Investments LLC will address these issues within twenty-four (24) hours. Other maintenance issues will be handled as quickly as possible. These issues include TV/cable/internet/wifi, sound system, and any other issues not qualifying as emergencies. Guest can report these issues through the guest portal or by calling the office. Guest agrees not to seek compensation if Soleil Investments LLC does not address a non-emergency within twenty-four (24) hours.
19. In the event of a dispute or disagreement regarding services received, the reservation holder should reach out to Soleil Investments LLC directly to discuss any issues and/or compensation. Should this not be effective, the guest has the right to file a complaint with their credit card company. Should this chargeback be unsuccessful, Soleil Investments LLC reserves the right to file against the reservation holder with a collections agency, which will result in any balances due being reported to the credit bureaus. Soleil Investments LLC reserves the exclusive right to prohibit or cancel reservations providing all payments received are returned to the guest within seven days of notification.
20. Severe Weather Policy: We do not offer any refunds for hurricanes or tropical storms. We recommend a third-party travel insurance policy. It is up to the guest to purchase travel insurance coverage. Soleil Investments, LLC shall not be liable for Acts of God that may interfere with guests scheduled stay including but not limited to Acts of God, acts of government agencies, fire, strikes, war, tornado, ice storm, environmental issues, severe weather, bridge closures, loss of public services. We recommend purchasing travel insurance.
