Rental Agreement
This Vacation Short Term Rental Agreement (the “Agreement”) is made by and between the guest (also referred to as “you”) and The Gyryk’s Cabin LLC (“Owner” and also referred to us “we” or “us”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is hereby acknowledged, Owner and Guest agree as follows:
Property: The “Property” is the real and personal property in Houfy listing #77785 (https://www.houfy.com/77785). Subject to the terms of this Agreement, Owner gives permission for Guest to use the Property for vacation rental use from 4:00 PM on the Arrival Date and 11:00 AM on the Departure Date.
 
Rental Party and Maximum Occupancy: The “Rental Party” shall consist of the number of Adults and Children indicated above, including Guest. All persons in the Rental Party will be bond by the terms of this agreement. You agree you will not permit anyone other than the Rental Party to stay overnight at the Property without the advance written permission of the Owner. Our maximum occupancy is 12 people. We have outside security cameras which we can use to confirm number of people, pets and illegal activities such as as trespassing neighbors properties.
 
Payment of Total Fee: You agree to pay the Total Fee by the Total Fee Due Date.
 
Cancellation Policy: If you cancel 60 days or more before your Arrival Date, then you will receive a 100% of refund of your Total Fee and Deposit will be returned in full. If you cancel less than 60 days but more than 30 days before your Arrival Date, then you will receive a 50% of refund Total Fee and Damage Deposit in full. If you cancel lass then 30 days you then forfeit your Total Fee. Damage Deposit will be returned to you. Non-payment of your Total Fee by the Total Fee Due Date will be considered your cancellation of reservation. Changes to the reservation will only be made at the discretion and upon the written agreement of Owner. Early departure does not warrant any refund of Total Fee. No refunds are granted for inclement weather or air quality from drift fire smoke (which can travel hundreds of miles), due to natural disasters, or due to any inconveniences beyond the Owner’s control, unless ALL roads into Arnold are completely closed eight consecutive hours or more from noon on your Arrival Date. Your reservation is valid for the remainder of the time.
 
Arrival: You are permitted to enter and use the Property starting at 4:00 PM on the Arrival Date. When available, we offer the ability to check-in anytime on your Arrival Date for an additional fee. Please let us know if you would like an earlier check-in time and, if possible, we will try to accommodate you. When you arrive, please check for cleanliness. If anything is not acceptable, then please call us immediately and we will attempt to remedy the situation.
 
Departure: You agree to vacate the Property by 11:00 AM on the Departure Date. When available, we offer the ability to extend your departure to 5:00 PM for an additional fee. Please let us know if you would like a later check-out time and, if possible, we will try to accommodate you. You agree to leave the Property in the condition required by your our “Departing Checklist” (which is will be emailed to you, as well as will be in our Guest Handbook at the Property).
 
 
Good Neighbors: You agree that you (and any person permitted on the Property by you) will be considerate of our neighbors, community, and wildlife by (1) not creating excessive noise in the early morning and late night; (2) not disturbing neighboring property owners or guests or their property, no trepassing neighbors properties ; (3) not leaving any food or trash outside; and (4) complying with the CC&Rs of the ‘Meadowmont Homeowners’ Association (located online at https://meadowmontpoa.com/wp-content/uploads/2022/10/MPOA-CCR.pdf). Quiet hours are 9 pm - 8 am strictly enforced by noise monitors and outside security cameras.
 
Certification: You represent that you are at least 25 years of age and agree that any person under the age of 25 that stays at the property during your stay will be accompanied by his/her adult Guardian or Parent. If your reservation is made under false pretense, including but not limited to falsified name, age, or size of party, you will be subject to immediate eviction and forfeiture of all amounts paid.
 
Prohibited Items and Activities: No smoking or illegal activity of any kind is allowed on the Property. No parties. The following are prohibited from being brought, stored, or used on the property: contraband, illegal drugs, fireworks, weapons of any kind, BB guns, pellet guns, air riffles, paintball guns, airsoft guns, slingshots, bows and arrows, explosives and other hazardous materials. No fires are permitted on or around the property except for the safe, responsible and intended use of the wood stove and outdoor grill. Appliances must be attended while in use.
 
Condition of Property: Owner cannot guarantee against mechanical failure of electrical service, plumbing, water supply, heating, audio/visual equipment, internet access, or appliances. Guest agrees to report any inoperative equipment or other maintenance problem to Owner immediately. While we will attempt to have it repaired, it is not always possible to arrange for tradespeople to attend to problems at nighttime or over holidays and weekends. Owner is not responsible for any inconvenience that may occur, and no refunds or reductions will be made due to such failures. Mountain living sometimes requires roughing it! You are likely to encounter different insects and animals than in the suburbs and cities. We provide toilet paper, paper towels, soap, shampoo etc. Please be advised that no special efforts have been made to “childproof” the Property, and you accept the risk of harm to any children allowed on the property during your stay. These risks include but are not limited to ingesting cleaning supplies, choking on small items, touching the fireplace, outlets or grill, falling from windows, beds, decks or stairs, toppling appliances or furniture an entanglement in chords.
 
Winter Suggestions: Please only plan a winter trip to Arnold if you have an adventurous spirit. Winter can bring beautiful snow, but with it you can expect hours of shoveling, power outages (although our cabin is equipped with a full-house automatic generator), internet outages, downed trees, fallen power lines, ski resorts closures, icy roads and driveways and hours-long road closures due to accidents and road hazards. You agree to read and comply with the instructions contained in our winter information document located on the Guest Handbook. Please note that tire chains are required most of the time after the town of Murphys (even if you have a 4x4 or AWD, unless your 4x4 or AWD has snow tires).
 
Vehicles: Area rules require the owners and guests park vehicles in driveways rather than on the street. Please restrict your vehicles to no more than four.
 
Violation of agreement: Violation By you or any person permitted on the Property by you of any of the provisions of this Agreement will automatically authorize Owner to terminate this Agreement and enter the property. Upon notice of such termination of this Agreement, you shall vacate the Property immediately, without refund or fees or deposit.
 
Damage: You agree to be responsible and to timely compensate Owner of any damage or loss due to use by you (or persons permitted on the Property by you) of the Property during your occupancy. You agree to report damage immediately so we can give you proper instructions and so we might replace the damaged or lost item in time for our next guest’s visit. Cost to repair or replacement will be deducted from your deposit or claimed through insurance if guest bought one; however, forfeiture of your Deposit will not relieve you of responsibility of the costs of such damage or loss in excess of the amount of the Deposit.
 
Waiver of Liability: You acknowledge the risks inherent in occupying Owner’s Property and knowingly and freely assume these risks. You waive any and all liability against Owner (The Gyryk’s Cabin LLC) for any accidents, injuries, illness, death or loss of or damage to property that occur to you, any member of the Rental Party or anyone permitted on the Property during your occupancy.
 
Indemnification: You agree to indemnify and hold Owner (The Gyryk’s Cabin LLC) harmless from any and all claims, liability, damages, expenses and costs (including, but not limited to, attorneys fees) caused by or arising from (1) the negligence, misconduct, disturbing the peace, violation of or non-conformance with this Agreement or with area laws, rules and regulations by you (or persons permitted on the Property by you), and (2) use by you (or persons permitted on the Property by you) of the Property or the surrounding property or environmental conditions (including but not limited to rain, snow , ice or flood).
 
Right of Access: If requested by Owner and upon prior notice, or in the case of an emergency, you agree to allow Owner (or a representative of Owner) access to the Property during your stay.
 
Miscellaneous: This Agreement does not create a tenancy all residents. All references to days indicate calendar days. This Agreement is governed by the laws of the state of California. The provisions in this Agreement shall be deemed independent and severable, and the invalidity or partial invalidity or unenforceability of any one provision shall not affect the validity or enforceability of any other provision. Failure to enforce any provision on this Agreement shall not constitute a waiver of the rights to enforce that provision or any provision of this Agreement. This Agreement is not an offer and shall not be considered effective until it has been signed by both Guest and Owner. Until then, rates and rules are subject to change.
 
By signing below, I, the Guest, am certifying that I have read and agree to all the terms and conditions in this Agreement.
