We strive to make our condo extremely versatile. It is family friendly, but it also has 2 King Bedrooms which makes it great for couples traveling together. It is well stocked so that you can come and enjoy your time and hopefully have everything you need at your fingertips. Sometimes, as with any vacation, things can arise that are out of everyones control, and if that does happen, we are just a text/phone call away and ready to handle any issue. This 11th floor condo has a large balcony that overlooks the pool with a beautiful view of the gulf. You can walk from your comfortable living area or master bedroom onto the grand balcony. This wonderful vacation condo has a king master bedroom, a king bedroom, and a 3rd bedroom with two queen beds. Also a queen size pull out sofa in the living room. The unit has a fully stocked, chef friendly kitchen with granite counter tops and stainless steel appliances. You can enjoy the big game or a family movie night on the large 55 Vizio Smart TV in the living room. There is a 32 flat screen in the master bedroom and 26 flat screen TVs in the other bedrooms. Netflix available through cable on all TVs if you have an account to login. The shower with body jets makes the master bath a must see! Dont forget the indoor pool and hot tub for those bad weather days, and the gym and sauna if you are sticking to a healthy routine. Across the street at our sport facility, we have basketball courts, a putting green, and a Pickleball Court! Shopping centers within walking distance include restaurants, Rouses, Wal Mart and Publix just down the road. By and large, this is a condo rental you will want to repeat!

~ We have a community sharing drawer where you will find aluminum foil, sandwich bags, and plastic wrap. There is also a cabinet with basic spices which also includes sugar, coffee, non-stick cooking spray, etc. For the benefit of all, please dont deplete and feel free to add to the assortment.
-We provide all the dishes, silverware, and kitchen utensils and appliances such as a coffee maker, crock pot, blender, toaster, mixer, pots, pans, bowls, casserole dishes, and pretty much anything you will need to cook full meals.
-For children, we have a pack n play (crib) and a children’s high chair. Please do not take to the beach.

This Renter’s Agreement is made and effective from date of first payment for rent of Airbnb "Family Tides" between Owner (S & D P) and Renter regarding the property known as "Family Tides" which is located at:

This Agreement applies to the Guest's stay at Rental Property from but also applies to any other dates which may be included if the reservation is changed.
This Agreement applies to all members of the Guest's party no matter the age or affiliation. Guest acknowledges that Guest is responsible for sharing the renter agreement, and its requirements, with all members of the Guest's party and anyone else permitted onto the Rental Property by the Guest.
In consideration of the rent received and the mutual promises contained herein, Owner of the Rental Property does hereby lease and rent to Guest(s) such Rental Property under the following terms and conditions:
1. Guest agrees to abide by all rules and regulations contained herein or posted on the premises related to the Rental Property. Guests obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses. Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation. Guest's breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind.
2. Age Restriction: Primary Renter must be at least 25 years of age, if single. Guests under the minimum age must be accompanied by a parent or legal guardian. No exceptions. A valid driver’s license must be presented at check in, if required. Our Ring doorbell camera may be used for this validation. Any reservation obtained under false pretense will be subject to forfeiture of any payment, reservation fee or final payment and check-in will not be permitted or eviction of guest who has already checked in may occur.
3. Security Cameras: Security Cameras (Ring doorbell) may be present at the entrance and utility equipment areas. Cameras are not to be tampered with. For privacy reasons, we do not have cameras in occupancy areas of the unit.
4. Max Occupancy: In no event shall the Rental Property be occupied by more persons than the capacity of the property as stated on the web site or the confirmation letter, without prior approval by Owner. No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval. In no event shall Guests assign or sublet the Rental Property in whole or in part. Violations of these rules are grounds for expedited eviction with no refund of any kind. Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property. Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair. If listed "For Sale", Guests agree to grant access by scheduled appointment upon notification.
5. Cancellation Policy: In the event Guest wishes to terminate this agreement, Travel Insurance, Damage Protection and any processing or administrative fees are non-refundable. The refund policy is as follows:
One hundred percent (100%) of the total booking charges will be refunded if the cancellation is made more than 30 days prior to the arrival date of the reservation. Fifty percent (50%) of the total booking charges will be refunded if the cancellation is made 30-14 days prior to the arrival date of the reservation. For cancellations made after 14 days prior to the arrival date, no refund will be issued.
6. Payments: A payment of 25% is taken by Owner at the time of the booking. Any remaining balance must be paid 30 days prior to the arrival date, or this Agreement may be cancelled by the sole option of the Owner. An automatic credit card payment for the remaining balance will be scheduled by the Owner to be made 30 days prior to the arrival date. The credit card of the first payment is used if a credit card was provided. If the automatic payment fails for any reason, it is the responsibility of the Guest to make sure that the remaining balance is promptly paid in full, or the reservation will be canceled with no refund of payments made. All policies contained in this Agreement shall apply equally to payments made by credit card, check or cash and whether made via website, by phone or in person.
7. Damage Deposit: A damage deposit of $500 if, at the end of the rental period, the rental property is returned damaged beyond normal wear and tear, the will be used for repairs. In the event of any damages, Owner will provide Guest with a full accounting of expenses incurred and deductions made from the Security Deposit. Should the damages exceed the amount of the Security Deposit, Guest agrees to pay the balance within five (5) business days after receiving notification. Deductions from Security Deposit may include, but are not limited to: excess cleaning fee, trash removal fee, missing item replacement costs, damaged item replacement or repair costs, repair costs of buildings or grounds, or other service call fees. Owner is under no obligation to use the least expensive means of restoration.
8. No Pets. No Exceptions. Any pet(s) found in or about the Rental Property will be grounds for expedited eviction and forfeiture of all monies paid.
9. No refunds will be provided due to inoperable appliances, pools, hot tubs, elevators, etc.
The Owner will make every reasonable effort to assure that such appliances will be and remain in good working order. No refunds will be given due to power blackouts, water shortage, flooding, snow, construction at adjacent properties, or mandatory evacuations of the area by county officials due to hurricanes or other potentially dangerous situations
arising from acts of god or nature.
10. Early Departure: The property is individually owned. If you leave before the end of your
reserved stay, the owner of the property will suffer a loss of rental income. For this
reason, no prepaid rent is refundable.
11. Phones: There is no landline in this property.
12. Summer House Office Contact: Guests are not to directly contact Summer House
Management. Any issues with plumbing, maintenance, cleanliness, etc. must ONLY go
through the Owners at 251-591-5180. Any guest initiated maintenance or service calls that result in charges will be the sole responsibility of the guest and will not be reimbursed. Fees related to clogged toilets or other guest induced issues will be charged to the guest.
13. Security or Personal Property: We are not responsible for any acts of theft or vandalism or other damages to any personal property or for personal items left by guests in the accommodation at departure.
14.Owner’s Property: We respectfully request that you remember you are staying in someone’s home during your vacation. Please treat it with care and leave it in good condition at checkout.
15. Safety Rules:
~No open flames or grills on wooden decks or beach.
~Fireworks cannot be used on the beach, the property grounds or balconies.
~No trespassing on open roof areas.
~Glass containers are prohibited on beach and around pool.
~Do not feed birds from decks.
~No water balloons, etc. thrown from decks.
16. General Rules (where applicable):
~Boats and Trailers are not permitted in condominium parking lots. You must let us know if you are bringing a boat or trailer. In some areas, you must have a pass to put on the boat or trailer. There is a boat pass fee in most instances.
~Do not hang towels from the balcony railings.
~Please do not leave windows and doors open while operating air conditioning.
~If you are being disturbed by unnecessary noise after 10PM, please see the security guard or call the Baldwin County Sheriff at 911.
17. Furnishings: All rentals are individually owned and furnished according to each owner’s
preference. Please do not move furniture, including TV’s and DVD Player’s, from present location. If you remove accessories to protect children, they should be replaced prior to departure. Do not take patio furniture to the beach. Please do not move furnishings,
kitchen items or linens to another rental.
18. Linens: Bed, bath and kitchen linens are provided for your convenience. Please make
sure all linens, towels and other items are never removed from the unit both during and
after your stay. Items missing after your departure are subject to being billed on credit card on file. Linens or towels damaged from urine or other bodily fluids, spray tan, makeup, etc. or abuse will also be billed inclusive of expediting fees.
19. Beach Towels: PLEASE BRING YOUR OWN BEACH TOWELS! We do not permit towels,
sheets, blankets, or furniture to be removed from the property.
20. Forgotten Items: Items left in the unit or car during your stay are not the responsibility of
the property managers. If items are found in the unit, you will be notified. They can be
returned to the address you specify. There will be a shipping and handling fee to return.
21. Bed Wetting and Stains: Our mattresses are not waterproof. It is your responsibility to
protect the bedding. If, upon your departure, we find a mattress soaked with urine or fluids, bodily or otherwise, the mattress will be replaced and your credit card will be charged for the replacement.
22. Smoking Policy: No Smoking or Vaping. Smoking/Vaping is not permitted in the condo or home at any time. If our cleaning crew determines that smoking on our property has occurred, an additional fee no less than $250 will be assessed to your credit card for additional deep cleaning. Burn marks on any indoor or outdoor furniture will result in replacement costs billed to the credit card.
23. Luggage: Luggage carts are never allowed inside the unit. If damage to walls, floors, or
other property occurs your credit card on file will be billed.
24. Garbage: Please discard garbage in accordance with property guidelines.
25. Electronics (where applicable): Televisions are pre-programmed. Equipment is not to be modified in any way or relocated. Non-compliance will result in a $25.00 reprogramming fee. At check in, please notify us immediately if electronic equipment is not working properly.
26. Property Rules and Regulations: Please observe all rules and regulations governing the use of the property you are occupying. These rules apply to both owners and guests and failure to comply can result in eviction. You will be provided unit-specific Rules and Regulations approximately 30 -7 days prior to check-in date.
27. Supplies: We furnish 2 rolls of toilet paper for each bath, one roll of paper towels, laundry soap, liquid dishwasher detergent, and dish-washing liquid. We also furnish shampoo, conditioner, and shower gel for each bathroom.
28. Missing, Broken, or Damaged Items: Our cleaning crew keeps a thorough inventory of all furnishings and items provided for guest use. Any missing, broken, or damaged items will be billed to the credit card on file for the replacement costs.
29. In the event Owner is unable to make Rental Property available for any reason other than
described above or a reasonable substitute as determined by Owner, Guest agrees that
Owner's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability. Guest also agrees to indemnify Owner from and against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the spa, hot tub, sauna, whirlpool tub, pool, exercise equipment, elevator, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner.
30. Owner may terminate this Agreement upon the breach of any of the terms hereof by
Guest. Guest shall not be entitled to the return of any rental monies paid under the terms
of this Agreement and shall vacate the Property immediately.
31. Waiver of Liability: Guest agrees to indemnify Owner, Summer House Association
(HOA), and the contractors (such as but not limited to C-Sharpe) that may be hired by the
HOA or other unit owners against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including but not limited to, injury sustained as a result of the use of common areas, amenities, such as but not limited to the pools, hot tub, sauna, parking lot, play equipment, sports courts, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner, the HOA, or any contractors. Guest acknowledges that there may be construction equipment onsite for various projects at various times and will remain clear of such equipment and work areas with specific care to avoid overhead worker environments and the logical dangers that could be present in those areas. Guest agrees to honor HOA notifications of amenity closures and restrictions.
32. Agreement shall be enforced under the laws of the state within which the Rental Property is located, including any applicable rental acts of that state, and represents the entire
Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in the county within which the Rental Property is located. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement.
33.The Rental Property may offer access to recreational and water activities, including but
not limited to play sets and swimming. Guest fully understands and acknowledges that
outdoor recreational and water activities have inherent risks, dangers and hazards. Participation in such activities and/or use of equipment may result in injury or illness
including, but not limited to bodily injury, disease, strains, fractures, partial and/or total
paralysis, death or other ailments that could cause serious disability. Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. Guest hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person. Guest hereby voluntarily agree to release,waive, discharge, hold harmless, defend and indemnify Owner and any and all agents,employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Rental Property facilities, equipment, or activities. Guest further assumes full responsibility for the actions of any and all persons whom he may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons.
NOW, THEREFORE, in consideration of the mutual agreements and covenants herein contained, Guest has read and agreed to the following:
I understand the rules and rental conditions upon which I am agreeing to rent accommodations, equipment, and use of the property. I acknowledge and accept that the sole responsibility for safety lies with the participant. In agreeing to this, I acknowledge that outdoor activities and exposure to the natural elements and animals can be dangerous and sometimes result in injury and even death. Steps and decks can be slippery, animals and insects can threaten and infect or injure, exposure to the elements can cause hypothermia, sunburn, among other risks inherent in participating in camping, outdoor and water activities. I know that alcohol and/or drugs do not mix safely with any outdoor activity.
I am over the age of 25 and assume responsibility for those in my charge under the age of 25. I hereby assume all legal responsibility for bodily injury to me or to any person on the property as a result of my visit and use, operation or possession of equipment hired or loaned to me. Acknowledging this, I accept complete responsibility for the minor children and myself in my charge and visit the property and equipment and engage in activities or events at my own risk.
I will abide by the rules and accept these rental conditions:
*The property I rent will be returned in the same condition in which it was rented and I will be responsible for all damage and/or loss that occurs during my rental period.
*I agree to hold harmless and to indemnify the Owner of the Rental Property against all loss, damage, expense and penalty on account of personal injury or property damage to the rental dwellers, the undersigned or to any minor child or children in the charge of the undersigned, howsoever rising, whether by act or acts or failure to act of the employees, owners or animals of the said company or property owners or not.
*I acknowledge receipt of the property in good order and condition (if found otherwise per my arrival I will contact Owner immediately) and further agree that the Owner of the Rental Property shall not be liable for consequential damages of any kind or nature from whatever cause arising, whether property or equipment is loaned or rented.
*I enter into agreement freely with the Owner of the Rental Property at my own risk, acknowledging the risks inherent in indoor and outdoor activities and assume any and all responsibility for the minor children and myself in my charge.
*All parties agree to and will comply with Federal, State and County pollution laws and any other applicable laws and regulations.

This Renter’s Agreement is made and effective from date of first payment for rent of Airbnb "Family Tides" between Owner (S & D P) and Renter regarding the property known as "Family Tides" which is located at:
25020 Perdido Beach Blvd
Unit 1103A
Orange Beach, AL 36561
This Agreement applies to the Guest's stay at Rental Property from but also applies to any other dates which may be included if the reservation is changed.
This Agreement applies to all members of the Guest's party no matter the age or affiliation. Guest acknowledges that Guest is responsible for sharing the renter agreement, and its requirements, with all members of the Guest's party and anyone else permitted onto the Rental Property by the Guest.
In consideration of the rent received and the mutual promises contained herein, Owner of the Rental Property does hereby lease and rent to Guest(s) such Rental Property under the following terms and conditions:
1. Guest agrees to abide by all rules and regulations contained herein or posted on the premises related to the Rental Property. Guests obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses. Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation. Guest's breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind.
2. Age Restriction: Primary Renter must be at least 25 years of age, if single. Guests under the minimum age must be accompanied by a parent or legal guardian. No exceptions. A valid driver’s license must be presented at check in, if required. Our Ring doorbell camera may be used for this validation. Any reservation obtained under false pretense will be subject to forfeiture of any payment, reservation fee or final payment and check-in will not be permitted or eviction of guest who has already checked in may occur.
3. Security Cameras: Security Cameras (Ring doorbell) may be present at the entrance and utility equipment areas. Cameras are not to be tampered with. For privacy reasons, we do not have cameras in occupancy areas of the unit.
4. Max Occupancy: In no event shall the Rental Property be occupied by more persons than the capacity of the property as stated on the web site or the confirmation letter, without prior approval by Owner. No fraternities, school, civic, or other non-family groups are allowed unless Owner grants prior approval. In no event shall Guests assign or sublet the Rental Property in whole or in part. Violations of these rules are grounds for expedited eviction with no refund of any kind. Guests hereby acknowledge and grant specific permission to Owner to enter premises at any time for inspection purposes should Owner reasonably believe that Guests are causing or have caused any damage to Rental Property. Guest further agrees to grant Owner access to Rental Property for purposes of maintenance and repair. If listed "For Sale", Guests agree to grant access by scheduled appointment upon notification.
5. Cancellation Policy: In the event Guest wishes to terminate this agreement, Travel Insurance, Damage Protection and any processing or administrative fees are non-refundable. The refund policy is as follows:
One hundred percent (100%) of the total booking charges will be refunded if the cancellation is made more than 30 days prior to the arrival date of the reservation. Fifty percent (50%) of the total booking charges will be refunded if the cancellation is made 30-14 days prior to the arrival date of the reservation. For cancellations made after 14 days prior to the arrival date, no refund will be issued.
6. Payments: A payment of 25% is taken by Owner at the time of the booking. Any remaining balance must be paid 30 days prior to the arrival date, or this Agreement may be cancelled by the sole option of the Owner. An automatic credit card payment for the remaining balance will be scheduled by the Owner to be made 30 days prior to the arrival date. The credit card of the first payment is used if a credit card was provided. If the automatic payment fails for any reason, it is the responsibility of the Guest to make sure that the remaining balance is promptly paid in full, or the reservation will be canceled with no refund of payments made. All policies contained in this Agreement shall apply equally to payments made by credit card, check or cash and whether made via website, by phone or in person.
7. Damage Deposit: A damage deposit of $500 if, at the end of the rental period, the rental property is returned damaged beyond normal wear and tear, the will be used for repairs. In the event of any damages, Owner will provide Guest with a full accounting of expenses incurred and deductions made from the Security Deposit. Should the damages exceed the amount of the Security Deposit, Guest agrees to pay the balance within five (5) business days after receiving notification. Deductions from Security Deposit may include, but are not limited to: excess cleaning fee, trash removal fee, missing item replacement costs, damaged item replacement or repair costs, repair costs of buildings or grounds, or other service call fees. Owner is under no obligation to use the least expensive means of restoration.
8. No Pets. No Exceptions. Any pet(s) found in or about the Rental Property will be grounds for expedited eviction and forfeiture of all monies paid.
9. No refunds will be provided due to inoperable appliances, pools, hot tubs, elevators, etc.
The Owner will make every reasonable effort to assure that such appliances will be and remain in good working order. No refunds will be given due to power blackouts, water shortage, flooding, snow, construction at adjacent properties, or mandatory evacuations of the area by county officials due to hurricanes or other potentially dangerous situations
arising from acts of god or nature.
10. Early Departure: The property is individually owned. If you leave before the end of your
reserved stay, the owner of the property will suffer a loss of rental income. For this
reason, no prepaid rent is refundable.
11. Phones: There is no landline in this property.
12. Summer House Office Contact: Guests are not to directly contact Summer House
Management. Any issues with plumbing, maintenance, cleanliness, etc. must ONLY go
through the Owners at 251-591-5180. Any guest initiated maintenance or service calls that result in charges will be the sole responsibility of the guest and will not be reimbursed. Fees related to clogged toilets or other guest induced issues will be charged to the guest.
13. Security or Personal Property: We are not responsible for any acts of theft or vandalism or other damages to any personal property or for personal items left by guests in the accommodation at departure.
14.Owner’s Property: We respectfully request that you remember you are staying in someone’s home during your vacation. Please treat it with care and leave it in good condition at checkout.
15. Safety Rules:
~No open flames or grills on wooden decks or beach.
~Fireworks cannot be used on the beach, the property grounds or balconies.
~No trespassing on open roof areas.
~Glass containers are prohibited on beach and around pool.
~Do not feed birds from decks.
~No water balloons, etc. thrown from decks.
16. General Rules (where applicable):
~Boats and Trailers are not permitted in condominium parking lots. You must let us know if you are bringing a boat or trailer. In some areas, you must have a pass to put on the boat or trailer. There is a boat pass fee in most instances.
~Do not hang towels from the balcony railings.
~Please do not leave windows and doors open while operating air conditioning.
~If you are being disturbed by unnecessary noise after 10PM, please see the security guard or call the Baldwin County Sheriff at 911.
17. Furnishings: All rentals are individually owned and furnished according to each owner’s
preference. Please do not move furniture, including TV’s and DVD Player’s, from present location. If you remove accessories to protect children, they should be replaced prior to departure. Do not take patio furniture to the beach. Please do not move furnishings,
kitchen items or linens to another rental.
18. Linens: Bed, bath and kitchen linens are provided for your convenience. Please make
sure all linens, towels and other items are never removed from the unit both during and
after your stay. Items missing after your departure are subject to being billed on credit card on file. Linens or towels damaged from urine or other bodily fluids, spray tan, makeup, etc. or abuse will also be billed inclusive of expediting fees.
19. Beach Towels: PLEASE BRING YOUR OWN BEACH TOWELS! We do not permit towels,
sheets, blankets, or furniture to be removed from the property.
20. Forgotten Items: Items left in the unit or car during your stay are not the responsibility of
the property managers. If items are found in the unit, you will be notified. They can be
returned to the address you specify. There will be a shipping and handling fee to return.
21. Bed Wetting and Stains: Our mattresses are not waterproof. It is your responsibility to
protect the bedding. If, upon your departure, we find a mattress soaked with urine or fluids, bodily or otherwise, the mattress will be replaced and your credit card will be charged for the replacement.
22. Smoking Policy: No Smoking or Vaping. Smoking/Vaping is not permitted in the condo or home at any time. If our cleaning crew determines that smoking on our property has occurred, an additional fee no less than $250 will be assessed to your credit card for additional deep cleaning. Burn marks on any indoor or outdoor furniture will result in replacement costs billed to the credit card.
23. Luggage: Luggage carts are never allowed inside the unit. If damage to walls, floors, or
other property occurs your credit card on file will be billed.
24. Garbage: Please discard garbage in accordance with property guidelines.
25. Electronics (where applicable): Televisions are pre-programmed. Equipment is not to be modified in any way or relocated. Non-compliance will result in a $25.00 reprogramming fee. At check in, please notify us immediately if electronic equipment is not working properly.
26. Property Rules and Regulations: Please observe all rules and regulations governing the use of the property you are occupying. These rules apply to both owners and guests and failure to comply can result in eviction. You will be provided unit-specific Rules and Regulations approximately 30 -7 days prior to check-in date.
27. Supplies: We furnish 2 rolls of toilet paper for each bath, one roll of paper towels, laundry soap, liquid dishwasher detergent, and dish-washing liquid. We also furnish shampoo, conditioner, and shower gel for each bathroom.
28. Missing, Broken, or Damaged Items: Our cleaning crew keeps a thorough inventory of all furnishings and items provided for guest use. Any missing, broken, or damaged items will be billed to the credit card on file for the replacement costs.
29. In the event Owner is unable to make Rental Property available for any reason other than
described above or a reasonable substitute as determined by Owner, Guest agrees that
Owner's sole liability as a result of this unavailability is to provide a full refund of all monies paid under this Agreement and Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability. Guest also agrees to indemnify Owner from and against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the spa, hot tub, sauna, whirlpool tub, pool, exercise equipment, elevator, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner.
30. Owner may terminate this Agreement upon the breach of any of the terms hereof by
Guest. Guest shall not be entitled to the return of any rental monies paid under the terms
of this Agreement and shall vacate the Property immediately.
31. Waiver of Liability: Guest agrees to indemnify Owner, Summer House Association
(HOA), and the contractors (such as but not limited to C-Sharpe) that may be hired by the
HOA or other unit owners against liability for injury to Guest or any other person occupying Rental Property resulting from any cause whatsoever including but not limited to, injury sustained as a result of the use of common areas, amenities, such as but not limited to the pools, hot tub, sauna, parking lot, play equipment, sports courts, etc. except only such a personal injury caused by the gross negligence or intentional acts of the Owner, the HOA, or any contractors. Guest acknowledges that there may be construction equipment onsite for various projects at various times and will remain clear of such equipment and work areas with specific care to avoid overhead worker environments and the logical dangers that could be present in those areas. Guest agrees to honor HOA notifications of amenity closures and restrictions.
32. Agreement shall be enforced under the laws of the state within which the Rental Property is located, including any applicable rental acts of that state, and represents the entire
Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in the county within which the Rental Property is located. If any part of this Agreement shall be deemed unenforceable by law, that part shall be omitted from this Agreement without affecting the remaining Agreement.
33.The Rental Property may offer access to recreational and water activities, including but
not limited to play sets and swimming. Guest fully understands and acknowledges that
outdoor recreational and water activities have inherent risks, dangers and hazards. Participation in such activities and/or use of equipment may result in injury or illness
including, but not limited to bodily injury, disease, strains, fractures, partial and/or total
paralysis, death or other ailments that could cause serious disability. Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. Guest hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person. Guest hereby voluntarily agree to release,waive, discharge, hold harmless, defend and indemnify Owner and any and all agents,employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Rental Property facilities, equipment, or activities. Guest further assumes full responsibility for the actions of any and all persons whom he may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons.
NOW, THEREFORE, in consideration of the mutual agreements and covenants herein contained, Guest has read and agreed to the following:
I understand the rules and rental conditions upon which I am agreeing to rent accommodations, equipment, and use of the property. I acknowledge and accept that the sole responsibility for safety lies with the participant. In agreeing to this, I acknowledge that outdoor activities and exposure to the natural elements and animals can be dangerous and sometimes result in injury and even death. Steps and decks can be slippery, animals and insects can threaten and infect or injure, exposure to the elements can cause hypothermia, sunburn, among other risks inherent in participating in camping, outdoor and water activities. I know that alcohol and/or drugs do not mix safely with any outdoor activity.
I am over the age of 25 and assume responsibility for those in my charge under the age of 25. I hereby assume all legal responsibility for bodily injury to me or to any person on the property as a result of my visit and use, operation or possession of equipment hired or loaned to me. Acknowledging this, I accept complete responsibility for the minor children and myself in my charge and visit the property and equipment and engage in activities or events at my own risk.
I will abide by the rules and accept these rental conditions:
*The property I rent will be returned in the same condition in which it was rented and I will be responsible for all damage and/or loss that occurs during my rental period.
*I agree to hold harmless and to indemnify the Owner of the Rental Property against all loss, damage, expense and penalty on account of personal injury or property damage to the rental dwellers, the undersigned or to any minor child or children in the charge of the undersigned, howsoever rising, whether by act or acts or failure to act of the employees, owners or animals of the said company or property owners or not.
*I acknowledge receipt of the property in good order and condition (if found otherwise per my arrival I will contact Owner immediately) and further agree that the Owner of the Rental Property shall not be liable for consequential damages of any kind or nature from whatever cause arising, whether property or equipment is loaned or rented.
*I enter into agreement freely with the Owner of the Rental Property at my own risk, acknowledging the risks inherent in indoor and outdoor activities and assume any and all responsibility for the minor children and myself in my charge.
*All parties agree to and will comply with Federal, State and County pollution laws and any other applicable laws and regulations.
