VACATION RENTAL AGREEMENT
Terms of the Agreement:
1. This agreement is for a self-catered vacation rental. The Owner shall provide linens, towels, dining and kitchenware, as well other present items commonly used by the Owners. Bath towels, linens or cribs may not be removed from the home. An initial supply of bath soap, shampoo, laundry soap, dish soap, paper goods are provided by the Owner, further supplies are to be furnished by the Guests. Maid service is not included in the rental rate, it may be available at an additional rate.
2. Guests shall maintain the premises in a good, clean condition and use the premises only in a careful and lawful manner. Guests shall leave the premises in a good, clean condition at the expiration of the rental agreement and shall pay for maintenance and repairs should the premises be left in a lesser condition. Guests agree that the Owner shall deduct costs of said services from the security deposit prior to refund if the Guests cause damage to the premises or its furniture, fixtures or equipment, or extraordinary damage to towels and linens. If damage exceeds the Security/Damage Deposit amount, then the Guests shall pay the difference in full, by check or via the credit card on file, including any additional fees, fines and if necessary, attorney fees, as assessed by the Owner.
3. It is the Guests responsibility to learn about the safety precautions and procedures concerning being in and around the home and the community swimming pool. Guests agree to always have a responsible adult supervising minors. Guests should be aware that swimming pools could be hazardous if not properly used and fully accept all risks involved. Guests shall be cautious when entering and exiting the swimming pool.
4. Guests shall behave in a friendly manner and shall be good neighbors, respecting the rights of the surrounding property owners. Guests shall not create noise or circumstances likely to disturb the surrounding property owners. All rentals are to families and responsible adults, 25 years or older. High school or college groups, chaperoned or not, are not permitted. Events such as weddings, parties or catered celebrations are not allowed.
5. Cable television service and wireless Internet access are provided as a convenience and are not integral to this agreement. No refund of rents shall be given outages, content, lack of content, access problems, lack of knowledge of use, or personal preferences.
6. Appliance malfunctions or service requests for air conditioning, televisions, appliances, etc., will be notified and responded to as quickly as possible. No rebates or refunds shall be issued to the Guests for any temporary malfunctions, as every good faith effort is made to insure the property is maintained to highest standards.
7. Guests expressly recognize that any insurance for property damage or loss that the Owner may have for the property shall not cover the personal property of the Guests and that the Guest may purchase his or her own travel insurance. Guests agree to release and indemnify the Owner from and against all liability, should anyone be injured upon the premises during the term of the agreement. The purchase of travel insurance is highly recommended.
8. Guests shall see to their security while in the property, by locking the door when it is prudent to do so. The Owner shall not have any responsibility for lost, stolen or damaged items. Found Guest-owned items found will be held and every reasonable effort will be made to contact the Guests for their return. If items are not claimed after 30 days, they shall become the property of the Owner. The Owner shall not be held liable for condition of said items. There will be a minimum $25.00 fee, plus shipping, for any returned items.
9. There shall be no refunds of rents due to shortened stays or ruined expectations because of change in travel plans, weather conditions, nature emergencies, or due to work and family emergencies or other commitments. In the Caribbean, tropical storms and inclement weather are a natural possibility. We highly recommend the purchase of travel insurance from a travel insurance provider, such as www.InsureMyTrip.com.
10. The Owner has provided an adequate water reservoir tank and portable lighting to address possible outages, which the Guests shall use prudently. No refunds or compensation will be given for any outages beyond our control.
11. Guests agree not to access utility areas, Owner’s closets and private storage areas, even if unlocked, which may contain cleaning supplies and chemicals that could be hazardous to children and adults if opened.
12. If the responsible Guest or any member of his or her party violates any of the terms of this agreement, the Owner may, at the Owner’s sole discretion, terminate this agreement with no refund of the rental. If deemed necessary, the Owner may enter the premises and remove the Guests, the members of his or her party and their belongings, per expedited eviction procedures pursuant to local Law. Guests agree to pay all costs, attorney's fees and expenses that shall be made or incurred by Owner in the enforcement of this agreement.
13. Governing Conditions:
a. Check-in time is after 3:00 P.M.; Checkout time is before 11:00 A.M.
b. No animals or pets of any kind will be brought onto the premises; the owners are allergic. A $300 pet cleaning fee will be assessed if evidence of the presence of pets is found.
c. There shall be no smoking of any kind in any areas of the premises; the owners are allergic. A $300 smoke cleaning fee will be assessed if evidence of smoking is found.
d. No more than one Guest/visitor vehicles are allowed at the designated parking.
e. There is no landline telephone service. Emergency medical and police services can be called by dialing 911 on Guests cellular telephone.
f. Guests shall dispose of all waste material generated during the rental period in a proper manner and place properly bagged trash in the provided trash area during their stay. Guests are cautioned not to leave trash outside the bin because it attracts animals.
g. Guests agree that air conditioning shall not be set below 70 degrees Fahrenheit and that the fan setting shall be “Auto”. Doors and windows shall be closed when air conditioning is in operation, to avoid freezing and damage to the units. Guests also agree to shut-off all air conditioning units, ceiling fans and lights prior to departing for several hours.
h. Before entering the community swimming pool, all persons must shower to remove sand, oils and lotions and must follow normal and sensible precautions. If glass, beach sand, or any other solid or liquid foreign matter is found in the pool after the Guest’s stay, health regulations require that the pool be emptied.
i. Lost keys will result in an emergency locksmith entry fee in addition to a lock change fee, to be determined by our actual costs at the time of the loss.
14. Security/Damage Deposit:
A security/damage deposit of at least $200 is required to rent this property. The deposit will be held until after the property is vacated by the Guests and refunded after departure if no damage to the premises occurred. If the property, or its amenities have been damaged as a result of misuse, neglect (intentional or accidental), then the cost for all repairs (including parts, articles, labor fees, legal fees, fines, attorney’s fees, etc.) needed to restore the rental home to the condition that it was in when the Guests rented the property, shall be assessed and deducted. If the damage exceeds the Security/Damage Deposit amount, then the Guests shall pay the difference in full, including legal fees, fines, and attorney’s fees, as assessed by the Owner.

16. Liability Waiver:
The Owner assumes no liability for Guests usage of the property, community swimming pool and other common areas. Use of the property by all Guests and visitors shall be at their own risk and the Guests understand the recommendation to avail themselves of travel insurance.
