Violation is cause for eviction without refund and will result in liability of any and all damages that have resulted due to this infraction.
FALSIFIED RESERVATIONS: Any reservation obtained under false pretense, booking for someone else or in violation to the terms and conditions of this agreement will be subject to eviction without refund. Parents, and /or adults over the age of 25, are not allowed to check-in and then leave the property to under-aged guest(s); they must stay at the property throughout the duration (nightly) of the reserved dates.
DAMAGE AND CLEANING ISSUES: Any damage or cleaning issues noticed upon arrival should be reported to us immediately. If you experience any problems whatsoever with the vacation property during your stay, please contact us and we will do our best to rectify the matter as soon as it is practically possible.
You will not incur any additional charges if the following items are adhered to:
No damage is done to the unit or its contents including the linens
No items are missing upon inventory check.
All debris, garbage and discards are placed in the proper containers.
All soiled dishes are placed in the dishwasher.
There is no smoking or evidence of smoking in the unit.
Unit is left in neat condition.
There is no evidence of pets or signs of pet damage.
No excessive cleaning needed.
QUIET ENJOYMENT: Building ordinances prohibit unreasonable disturbance of others. Please respect the privacy of our neighbors. The townhouse is connected to 2 other units and noise is to be strictly enforced. Quiet hours are observed between 10:00pm and 7:00am. Violation and breach of peace includes loud parties, fireworks and/or music heard on the outside of the unit with windows and doors secured. Unregistered guests of the property are required to depart no later than 11:00pm. Offenses of this policy will result in eviction without refund.
NO SMOKING: Smoking of any kind within the property or outside on the patio, causing the property to smell of smoke or disturbing neighbors will not be tolerated. If evidence of smoking, cigarette butts, or ashes are evident, a $200 fine will result. NO EXCEPTIONS.
COMMUNITY RULES: Guests agree to abide by the rules of the community. Located near the unit is the community pool for resident use. The pool is open year-round, but is not heated. No unaccompanied minors in the pool under age 16. Please follow all posted pool rules. Pool key should always be returned to hook by the front door. $25 fee for lost pool key.
PARKING: Use of garage is encouraged for added security. Driveway is second option. Remote is located by front door on hook. Please be mindful of pulling in too far as washer & dryer are at the front of garage, large trucks & SUVs should be parked on driveway to prevent damage. Always close garage, even when home, as we cannot be held responsible for stolen items. Garage remote should be returned to hook by the front door, prior to your departure. $50 fee for lost remote. No commercial vehicles, trailers, campers, motor homes, boats, or similar recreational equipment may be parked in driveway or on community streets.
MAIL / DELIVERIES: USPS will not deliver to non-residents. You can however have your mail forwarded to a P.O. box at the Chandler Post Office at 101 N Colorado St, Chandler, AZ 85225. Keep in mind if ordering on Amazon, they sometimes use USPS for deliveries. Using an Amazon locker would be your best / safest option. There are many locations nearby. FedEx & UPS do deliver with door drop off.
PET POLICIES: Pets are not permitted in the unit or patio. This refers to any type of animal. Evidence of pets, animal hair in the unit, or pet stains on the furniture, beds, or carpet will result in a $100 fine. Violation of the pet policy subjects the guest to additional fines, cleaning fees, or termination of the rental period.
LOST, STOLEN, AND MISPLACED ITEMS: We assume no liability for items that may be lost, stolen, misplaced, or damaged during the duration of the rental period. In the event that personal items are left behind after departure, please contact us to arrange return shipping. Items will be returned at the expense of the guest.
LOCKOUT AREAS: Owner cabinets, are designated off-limits to guests. Violation especially by forced entry will be reported to local authorities as breaking and entering. Please regard any and all locked spaces as those for owner use only. Areas that are forcibly entered will result in a fine of $500 for damage or repair.
INDEMNIFICATION: In the event of any accident or incident that causes damage, bodily injury or casualty to the guest or any member of the occupying party, by acknowledgement of this agreement, all occupying parties agree collectively to hold harmless and waive the right to hold negligent The Sterling Saguaro LLC and any and all representatives thereof.
INTERFERENCE WITH STAY: The Sterling Saguaro LLC will make every effort to stay informed of pending construction, closure of facilities related to the property, and upcoming events that can cause disturbance, etc. Guest(s) will be notified as soon as possible.
RIGHT OF ENTRY: The Sterling Saguaro LLC or an agent acting on their behalf may enter upon the leased property at any time for the protection and preservation of the property, in the event of an emergency, or known or suspected violation of policies set forth by this agreement. When entry is necessary for repairs or services agreed upon by both parties, we will make every effort to provide ample notice. Inability to extend such notice shall not, however, prohibit entry.
GOVERNING LAWS: This agreement shall be governed by the laws of the state of Arizona. Each of the parties irrevocably consents to the exclusive personal jurisdiction and governing laws of the federal and state courts located in the state of Arizona and within Maricopa as applied, for any matter arising out of or relating to this Agreement.
