This Guest Occupancy Agreement is entered into by John Tolosky & Alecia Armstrong as the Homeowners And NAME, who shall be the designated person handling the rental on behalf of the family and/or group and is held responsible for the others’ behavior and adherence to all rules, regulations, and laws set forth by Vermont. OPTIONS ~
· $25/hour, for any part of an hour, for early check-in. Please let owner know if you are wanting to check in early. We will try and accommodate. Done on a case-by-case basis.

· $50/hour, for part of any hour, for UNAUTHORIZED late check-out.
Requests for extended stays will require a separate contract.
SHORT-TERM RENTAL ONLY ~ What are the rules about our status? This Guest Occupancy Agreement does not create a tenancy for the property. Guests may not let, sublet or assign this rental for all or any part of the rental period or part of the premises to anyone else not listed on the contract.
Turn off outside lights when not needed- Local ordinance requires that we not keep outside flood lights on all night. We’ve left them on for your safe arrival. Quiet hours from dusk to dawn- Once you see the first star at night, it’s time to be careful with noise levels. No loud outside music etc. In effect 9PM - 10 AM. CHECK THINGS OVER AT BEGINNING ~ Alert us to anything wrong, right away. DAMAGE ~ Please call us and let us know as soon as possible. MOVING ITEMS ~ Put everything back where it was, before you leave. ALLOWED TO USE~ Use anything in the main parts of the home. There will be areas marked “PRIVATE” such as the basement, which is under surveillance and a couple of closets. ITEMS LEFT ~ We will charge a "time and trouble" fee of $30. Must contact us for such items. NO SMOKING ~ This is listed as a non-smoking property. If there is a smoker in the group, be sure they smoke outside and do not leave butts anywhere or on the grounds. OWNER ACCESS ~ Usually no, but in an emergency or urgent circumstance, yes. You shall allow us, the homeowners, to access the property for purposes of maintenance, repair, and inspection at any time. DON’T DO IT! ~Forbidden: Beer pong inside, glitter, fireworks & fire crackers, confetti, silly string, smoking, slime, children with candy/gum/juice boxes in the bedrooms, temporary hair dyes or anything that will burn/stain/tear/ruin items etc. RULES-Posted on site you booked through. RECYCLINGrequired per Vermont law. Recycling Guide is in the kitchen. NO REFUNDS if part of the group is unable to attend for any portion of the stay.
HOLD HARMLESS ~ Do I have to assume risk while staying? Yes. (AS-IS, WHERE-IS; INDEMNIFICATION). You agree to indemnify, defend and hold harmless the cottage’s owner, manager, agents, assigns and all of their respective partners, owners, officers, directors, employees and agents (all of the foregoing are hereinafter, separately and collectively referred to as “Indemnitees”), from and against all claims, causes of action, losses, damages, suits and liability to every kind, including all expense of litigation, court costs and attorney’s fees for damage to any property, or for injuries to or sickness or death of any person caused by, arising out of or related, directly or indirectly, to the use or enjoyment of the premises by you, any of your guests, invitees or any other person or entity, on the premises under the authority or consent of you. This indemnity shall apply even though any such damage, injury, sickness or death is caused in whole or in part by any defect in or condition of any such property or any defect in or condition of any area, facilities, equipment, tools or other items which may be provided by Indemnitee, whether or not such defect or condition was known by Indemnitee. This indemnity shall apply regardless of whether or not any such damage, injury, sickness or death is contributed to by the negligence or fault of Indemnitee, and also even though Indemnitee is strictly liable therefor. Furthermore, this indemnity shall include, but not limited to, any claim or action for damages on account of injury to or illness or death of a guest, member, or invitee of the renter. Under the provision of this indemnity, the renter is agreeing to indemnify Indemnitee from Indemnitee’s own negligence or fault, but this indemnity shall not apply to any such damage, injury, sickness or death which was caused by the sole negligence or sole fault or Indemnitees and which was not caused in part by the negligence or fault of the renter, your guests, invitees, or any other person or entity. If requested to do so by Indemnitee, the renter will assume, without expense to the Indemnitee, the defense of any such claims or actions and will reimburse Indemnitee for all expenses (including without litigation court costs and attorney’s fees) incurred in investigating, handling and defending against any such claim or action. In plain terms …..GUESTS ASSUME FULL RISK IN TERMS OF INJURY TO ANY GUEST IN THE PARTY You agree that the use of the home and any amenities are at your discretion and own risk. You agree to take full responsibility for any injury resulting in the use of items on the property, including boats, floats, and other water related sports. Further, you may opt to play games and sports on the property, but agree to take full responsibility for any injuries resulting from such use and not hold the owner responsible in any way. ____
DISABILITY OF PREMISES ~ What happens if the property becomes disabled? Disability of Premises: In the event the premises become disabled in any way by “Act(s) of God”, or mechanical breakdown, the disability will be assessed and a decision will be made between guest and homeowner as to the extent of damage and the impact on the stay. We, the homeowners, will act timely and arrange to have any damage or repairs done as quickly as possible based on, and provided repair resources are available to perform specific repairs. You, the guest, may leave if you decide it is a hardship in any way. If you choose to leave, only then will you be refunded the unused days remaining based on arrival start time agreed, usually 4 PM on the 1st day of rental, and departure of 11 AM on the final day. Refunds will not apply in the case of neglect by you or your guests, resulting in damage to the premises that require repair immediately or render the property unfit. If you or your party damage anything and do not pay for it, we will exercise the option of small claims court in Windsor County located in White River Junction, Vermont. This will be determined by homeowner. Rental fee to be reimbursed is based on a prorated basis by days already spent (any part of a day spent will constitute a full day or 24 hours) and the remaining days contracted until complete check-out. It will be your responsibility to find alternative accommodations at your own expense. POINT: Entire group/party must vacate the property entirely and not return. Reimbursement will occur within one week to one month from departure date if you rented via an Online Travel Agency. No refunds or rebates will be made based on weather; power failure; strike; civil or military disturbance; acts of terrorism; war; epidemic or pandemic; riot; acts of government; and any other circumstances beyond Homeowner’s reasonable control.

GUEST is encouraged to purchase vacation travel insurance. It is the responsibility of the Guest to determine appropriate insurance. Owner will not be held responsible for policies and terms of vacation travel insurance purchased by Guest. We recommend a policy that has "Cancel For Any reason" (CFAR).
OUR ADVICE for a happy stay - Have all adults in your party/group read this Guest Occupancy Agreement attachment. Coordinator should share the Welcome Guide with the entire group as well. Assign someone in the group to oversee the locking of the boats, someone to oversee the proper putting away of oars and life jackets, someone to oversee the woodshed and that toys and amenities are put back neatly and in an orderly way, someone to oversee the outside areas, someone in charge of overseeing that towels are placed in hampers provided, and etc. We often stay with our own family and friends and this really helps when everyone understands. Also direct people in the group to the Houfy WELCOME GUIDE provided. ____

As seasoned owners and travelers, we know how to find the perfect property and save. This is the inside scoop.....First, Google your criteria for a vacation rental. Look for no fee sites first. Chances are, the savvy owner will have a website, Google website, Houfy.com site, or Facebook page to advertise their site. Try to avoid VRBO/HomeAway/Booking.com/TripAdvisor/Airbnb because they add on booking fees they keep; it does not go to the owner! Some of the fees reach up to $499! If you find a place you want on one of those sites, try and Google the property name. Owners have already paid to advertise on those sites, so it's OK. However, do not contact them via that site as owners get dinged/demoted/shamed if they get too many inquiries and few bookings- ratios are measured and tracked. They will either delete the property or bury it in the list. If you do contact an owner on a big site, they are contractually obligated to keep you on the site and book you via that site. Many owners are working towards the "Book Direct" movement.
Always verify owners. Don’t be afraid to ask them to verify themselves. We had one person call Alecia at work.
